SINGH, JUDGE.   \nDate: 07.04.2010 \n:J U D G M E N T :\n<\/pre>\n<p>A Suit for permanent prohibitory injunction<br \/>\nrestraining the petitioners-defendants from interfering in<br \/>\nthe management, administration and other matters of<br \/>\nGhausia Jamia Masjid Bathendi Morh, Jammu and the<br \/>\nlanded property measuring 5 kanals 5 marlas comprised<br \/>\nin Khasra No. 331 min situated at Village Channi Rama,<br \/>\nJammu was filed by Alflah Gousia Muslim Trust, inter<br \/>\nalia, pleading that the Trust had been constituted by ten<br \/>\npersons namely Abdul Aziz Bhatt, Mushtaq Hussain<br \/>\nBaji, Mohd. Bashir, Abdul Rashid Mir, Sadiq Hussain,<br \/>\nAbdul Majid, Mohd. Aziz, Haji Shoket Ali, Haji Munshi<br \/>\n<span class=\"hidden_text\">2<\/span><br \/>\nand Mohd. Ashraf for, amongst others, better<br \/>\nadministration of Ghausia Jamia Masjid Bathendi Morh.<br \/>\nIt was indicated in the plaint that one of the<br \/>\npetitioners namely Ghulam Rasool had been<br \/>\nmismanaging and misusing the funds\/donations\/income<br \/>\nof the said Masjid Sharief in connivance with other<br \/>\npetitioners-defendants for last so many years.<br \/>\nThe petitioners contested the respondents&#8217; Suit<br \/>\ndenying the allegations of mismanagement of the affairs<br \/>\nof Ghausia Jamia Masjid Bathendi Morh which<br \/>\naccording to Ghulam Rasool was being administered<br \/>\nand managed by him as its President. According to the<br \/>\ndefendants, the plaintiffs had constituted a self styled<br \/>\nTrust to achieve their nefarious design of usurping the<br \/>\nproperty of the Masjid Sharief which was stated by the<br \/>\ndefendants to have been constructed on the land<br \/>\ndonated by Ghulam Rasool&#8217;s father. According to the<br \/>\ndefendants, Ghulam Rasool was managing the affairs of<br \/>\nthe Masjid Sharief smoothly with the help of other office<br \/>\nbearers. It was further indicated by the defendants in<br \/>\ntheir Written Statement that the plaintiffs had filed the<br \/>\nSuit against the defendants when the latter had not<br \/>\n<span class=\"hidden_text\">3<\/span><br \/>\nobliged them to part with the possession of the land in<br \/>\npossession of the Masjid where they wanted to raise<br \/>\nconstruction of some Shops.\n<\/p>\n<p>An ex-parte ad-interim injunction was issued by the<br \/>\ntrial Court of learned City Judge, Jammu on February<br \/>\n19, 2009 whereby the petitioners-defendants were<br \/>\ntemporarily restrained from causing any sort of<br \/>\ninterference in the management, administration and<br \/>\nother matters of Ghausia Jamia Masjid Bathendi Morh<br \/>\nand from interfering with the landed property measuring<br \/>\n5 kanals 5 marlas comprised in Khasra No. 331 min<br \/>\nsituated at Village Channi Rama, Jammu under the<br \/>\npossession and use of Ghausia Jamia Masjid Bathendi<br \/>\nMorh, Jammu. The defendants were further restrained<br \/>\nfrom collecting any donation in the name of Ghausia<br \/>\nJamia Masjid Bathendi Morh. This ex-parte order, on<br \/>\ncontest by the petitioners was made absolute vide trial<br \/>\nCourt&#8217;s order of May 26, 2009.\n<\/p>\n<p>Petitioners&#8217; Appeal against the Order before<br \/>\nlearned Principal District Judge, Jammu having failed,<br \/>\nthey have invoked the Revisional Jurisdiction of the<br \/>\n<span class=\"hidden_text\">4<\/span><br \/>\nCourt seeking setting aside of the orders of the trial<br \/>\nCourt and the Ist Appellate Court.\n<\/p>\n<p>I have heard and considered the submissions of<br \/>\nlearned counsel for the parties, gone through their<br \/>\npleadings, copies whereof have been placed on records<br \/>\nand the orders passed by the Courts below.<br \/>\nThe trial Court had come to the conclusion that as<br \/>\nthe operation of the two Trust Deeds, one relied upon<br \/>\nby the plaintiffs and the other by the petitionersdefendants,<br \/>\nwas in different fields and the subject<br \/>\nmatter of the Suit was covered by the Trust Deed relied<br \/>\nupon by the plaintiffs, so there was a prima facie case in<br \/>\nfavour of the plaintiffs justifying issuance of the<br \/>\ninjunction.\n<\/p>\n<p>Learned District Judge was, however, of the view<br \/>\nthat as the land over which the Masjid Sharief stood<br \/>\nconstructed was State land and did not belong to any<br \/>\nprivate person, so in order to benefit maximum people<br \/>\nof the locality, it would be just and proper if the property<br \/>\nin dispute was managed and administered by the<br \/>\nrespondents because the petitioners had been<br \/>\n<span class=\"hidden_text\">5<\/span><br \/>\nmismanaging and misusing the funds\/donations and<br \/>\nincome of the Masjid.\n<\/p>\n<p>Both the Courts below have dealt with the case<br \/>\nperfunctorily, avoiding prima facie determination of the<br \/>\nreal issues between the parties, which were necessarily<br \/>\nrequired to be examined to find as to whether or not the<br \/>\nrespondents-plaintiffs had succeeded in making out a<br \/>\nprima facie case justifying issuance of the impugned<br \/>\ninjunctive directions.\n<\/p>\n<p>The dispute projected by the plaintiffs-respondents<br \/>\nin their Suit did not refer to the affairs of Alflah Gousia<br \/>\nMuslim Trust alone, but pertained to the administration,<br \/>\nmanagement and affairs of Ghausia Jamia Masjid<br \/>\nBathendi and the land in possession of the Masjid<br \/>\nSharief. The plaintiffs&#8217; plaint indicates the petitionersdefendants<br \/>\nto have been managing the affairs of the<br \/>\nMasjid Sharief before the constitution of Alflah Gousia<br \/>\nMuslim Trust on February 13, 2009.\n<\/p>\n<p>The Trust Deed relied upon by the petitionersdefendants<br \/>\nspecifically records petitioner-Ghulam<br \/>\nRasool to have been managing the affairs of the Trust<br \/>\n<span class=\"hidden_text\">6<\/span><br \/>\nknown as Ghausia Memorial Trust from the premises<br \/>\nof Ghausia Jamia Masjid Bathendi Morh, Jammu.<br \/>\nAlthough the Trust Deed relied upon by the<br \/>\nplaintiffs does not hint at the mismanagement of the<br \/>\nMasjid by Ghulam Rasool, yet it impliedly indicates his<br \/>\nouster therefrom.\n<\/p>\n<p>The Petitioners-defendants had questioned the<br \/>\npower and authority of the settlers to constitute the<br \/>\nAlflah Gousia Muslim Trust saying that he could not be<br \/>\nousted from the management of the Masjid without<br \/>\nfollowing proper procedure therefor.<br \/>\nThe questions that, therefore, were required to be<br \/>\ndetermined though prima facie, to find the existence or<br \/>\notherwise of a prima facie case and other legal<br \/>\nrequirements justifying issuance of injunctive directions<br \/>\nwere inter alia as follows:-\n<\/p>\n<p>a) Whether the settlers of Alflah Gousia Muslim<br \/>\nTrust had any right to constitute the Trust for<br \/>\nthe management and administration of the<br \/>\naffairs of Ghausia Jamia Masjid Bathendi Morh,<br \/>\nJammu and were entitled to manage the affairs<br \/>\nof the Masjid Sharief?\n<\/p>\n<p><span class=\"hidden_text\">7<\/span><\/p>\n<p>b) Whether petitioner-Ghulam Rasool had infact<br \/>\nbeen ousted from the management and affairs<br \/>\nof the Masjid, if so, when and how?\n<\/p>\n<p>c) Whether the plaintiffs were in possession of the<br \/>\nMasjid and its properties and had any right to<br \/>\nseek injunctive directions against the<br \/>\ndefendants in respect of the management of<br \/>\nthe affairs of Ghausia Jamia Masjid Bathendi?\n<\/p>\n<p>d) Whether there was any material on records in<br \/>\nproof of the plaintiffs-respondents averments<br \/>\nthat the petitionersdefendants had been<br \/>\nmismanaging the affairs and misusing the<br \/>\nfunds of Ghausia Jamia Masjid Bathendi Morh?<br \/>\nAs the questions aforementioned, amongst others,<br \/>\narising out of the pleadings of the parties including the<br \/>\nright claimed by the petitioners-defendants to manage<br \/>\nthe affairs of Ghausia Jamia Masjid Bathendi have not<br \/>\nbeen determined by the Courts below to find the<br \/>\nexistence or otherwise of a prima facie case and other<br \/>\nlegal requirements justifying issuance of injunctive<br \/>\ndirections so their orders cannot be justified, in that,<br \/>\nthey have acted illegally in issuing the injunction against<br \/>\nthe petitioners without first addressing the questions<br \/>\nwhich they were required under law so to do.\n<\/p>\n<p><span class=\"hidden_text\">8<\/span><\/p>\n<p>Perusal of the trial Court&#8217;s ex-parte ad-interim<br \/>\norder, which was later made absolute, demonstrates<br \/>\ninjudicious exercise of jurisdiction by the learned City<br \/>\nJudge in issuing such injunctive directions at the interim<br \/>\nstage which, in effect and in essence, was the final relief<br \/>\nprayed for by the respondents in their Suit.<br \/>\nPower of the Court to dispense with the Notice<br \/>\nbefore considering issuance of ex-parte ad-interim<br \/>\ninjunction, contemplated by Order 39 Rule 3 of the<br \/>\nCode of Civil Procedure, too has been exercised in a<br \/>\nmechanical fashion and routine manner, without spelling<br \/>\nout the colossal loss that would have been caused to<br \/>\nthe plaintiffs in the event of issuance of a short Notice<br \/>\nbefore considering the respondents&#8217; application seeking<br \/>\nissuance of ad-interim injunction against the<br \/>\ndefendants.\n<\/p>\n<p>Dispensing with the Notice to the opposite party<br \/>\nbefore issuance considering issuance of injunction is<br \/>\nnot an idle formality and the Courts are required to<br \/>\nexercise this power only on the existence of good and<br \/>\nsufficient spelt out reasons in support of its opinion that<br \/>\nthe object of granting the injunction would be defeated<br \/>\n<span class=\"hidden_text\">9<\/span><br \/>\nby delay which may occasion in the issuance of Notice<br \/>\nto the opposite party.\n<\/p>\n<p>The trial Court has not followed the provisions of<br \/>\nOrder 39 Rule 3 of the CPC in letter and spirit while<br \/>\ndispensing with the issuance of prior Notice before<br \/>\nissuance of injunctive directions and thus erred in<br \/>\nissuing injunction of such a dimension which has the<br \/>\neffect of ousting the petitioners from the affairs of the<br \/>\nMasjid, which course may be contemplated only in case<br \/>\nof a very strong and exceptional prima facie case in<br \/>\nfavour of the plaintiffs warranting issuance of the<br \/>\ndirections which, if not issued would have rendered the<br \/>\nSuit infructuous or otherwise caused such irreparable<br \/>\ndamage or injury to the plaintiffs which may not be<br \/>\ncompensated by costs.\n<\/p>\n<p>Coming to the order passed by the first Appellate<br \/>\nCourt, it is found that the grievance projected by the<br \/>\npetitioners in their Appeal against the order of the trial<br \/>\nCourt and stated to have been demonstrated at the time<br \/>\nof its hearing has not at all been addressed to by the<br \/>\nlearned District Judge who has decided the Appeal in a<br \/>\nslip shod manner without dwelling on the issues which<br \/>\n1 0<br \/>\nwere required to be addressed before ruling on the<br \/>\ncorrectness or otherwise of the trial Court&#8217;s order and<br \/>\nerroneously recording finding without there being any<br \/>\nmaterial in support thereof that the petitioners had been<br \/>\nmismanaging the affairs of and misusing the<br \/>\nincome\/funds of the Masjid Sharief.\n<\/p>\n<p>Respondents&#8217; learned counsel&#8217;s plea that this<br \/>\nCourt should not interfere with the orders of the Courts<br \/>\nbelow in view of the law laid-down by the Hon&#8217;ble<br \/>\nSupreme Court of India in Managing Director (MIG)<br \/>\nHindustan Aeronautics Ltd. Balanagar, Hyderabad and another<br \/>\nversus Ajit Prasad Tarway, Manager (Purchase and Stores)<br \/>\nHindustan Aeronautics Ltd. Balanagar, Hyderabad, reported as<br \/>\nAIR 1973 SC, 76, is untenable, in that, both the Courts<br \/>\nbelow having been found to have exercised their<br \/>\njurisdiction illegally, the judgment referred to by the<br \/>\nlearned counsel would have no application to the facts<br \/>\nof the case.\n<\/p>\n<p>For all what has been said above, the orders<br \/>\nimpugned in the Revision Petition need to be set aside<br \/>\nrequiring the trial Court to examine the respondents&#8217;<br \/>\ncase for deciding their application seeking injunction<br \/>\nafresh.\n<\/p>\n<p>1 1<br \/>\nThis Revision Petition, therefore, succeeds and is,<br \/>\naccordingly, allowed, setting aside order dated<br \/>\n26.05.2009 of learned City Judge, Jammu and order<br \/>\ndated 26.09.2009 of learned Principal District Judge,<br \/>\nJammu.\n<\/p>\n<p>The matter is remanded to the trial Court for<br \/>\nconsideration afresh of respondents&#8217; application for<br \/>\nissuance of ad-interim injunction in accordance with law.<br \/>\nParties through their learned counsel are directed<br \/>\nto appear before the trial Court on April 17, 2010.<br \/>\nIn view of the orders passed in C.Rev.147\/2009,<br \/>\nContempt (C) No. D-1\/2010 does not require further<br \/>\nconsideration.
