PUBLIC PROSECUTOR\nfor Appellant(s) :\n1, \nNOTICE SERVED for Opponent(s) :\n1, \n=========================================\n\n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE Z.K.SAIYED\n\t\t\n\t\n\n \n\nDate\n: 17\/02\/2011\n \n\nORAL\nORDER<\/pre>\n<p>The<br \/>\n\tappellant-State has preferred the present appeal under Section 378<br \/>\n\tof the Code of Criminal Procedure, 1973 against the Judgment and<br \/>\n\tOrder of acquittal dated 30th September 1997 passed by<br \/>\n\tthe learned Judicial Magistrate First Class, Gandhinagar, in<br \/>\n\tCriminal Case No.6595 of 1989, by which the learned Magistrate was<br \/>\n\tpleased to acquit the present respondent of the charges levelled<br \/>\n\tagainst him.\n<\/p>\n<p>Heard<br \/>\n\tMr.H.L. Jani, learned Additional Public Prosecutor appearing for the<br \/>\n\tappellant-State. He has contended that the sole respondent has<br \/>\n\texpired on 01st March 2010. He has also contended that<br \/>\n\tMr.Sudarshan Negi, son of the present respondent-Bachansinh Fatesinh<br \/>\n\tNegi, wrote a letter to the Registrar General, High Court of<br \/>\n\tGujarat, intimating death of his father.\n<\/p>\n<p>I<br \/>\n\thave perused the papers as well as submission advanced by Mr.Jani.<br \/>\n\tIt appears from the letter of Mr.Sudarshan Negi that the sole<br \/>\n\trespondent has expired on 01st March 2010. Mr.Negi has<br \/>\n\talso annexed copy of Death Certificate of his father i.e. Bachansinh<br \/>\n\tFatesinh Negi. Hence, in view of death of the sole respondent,<br \/>\n\tpresent appeal stands disposed of as abated.\n<\/p>\n<p>(Z.\n<\/p>\n<p>K.
