The petitioner claims to be the daughter~in~<\/p>\n<p>iiaw of one Dr. B.K.Ramanna, who was the owner of the<\/p>\n<p>property bearing No.66, old. No.599, Margosa Road,<\/p>\n<p>Malleswaram, Bangalorew3. He entered into an B<\/p>\n<p>,\/<br \/>\n M<\/p>\n<p>4 CMP 127\/O8<\/p>\n<p>agreement on 26.06.1995 with the 35&#8243; respondent for<\/p>\n<p>development of Schedulee&#8221;A&#8221; property. vwglhe<br \/>\ndevelopment agreement envisaged construction *ofl&#8221;a<br \/>\nmultiestoried apartment building and the_sharingtof-r<br \/>\nthe built up area between the 1% respcngent and the\u00e9h<br \/>\nfather-in-law-of the petitioner was in the ratie 5::<br \/>\n67:33. The 1&#8243; respondent had cailea the prpjegf aV_i<br \/>\n36 as the name of the builging was unoeciged. The<br \/>\nfathereinelaw of the petitioner di\u00a7\ufb01.0W 26th August<br \/>\n1995 leaving behind malgwili idategt&#8217;l9.06.l995.<\/p>\n<p>Pursuant to the said Will; the petitioner claims to<\/p>\n<p>be a legatee, git appears that ouring the lifeetime<br \/>\nof the ifather5in}law_ of _the petitioner, he was<\/p>\n<p>negotiating ahwith. itheg} la&#8217; respondent for the<\/p>\n<p>_qeveiopment Of~,&amp;5chedule&#8211;&#8220;AF property and was<\/p>\n<p>&#8216;expecting to be given three apartments in the ground<\/p>\n<p>floor ana one would be in the first floor. But,<\/p>\n<p>Vhowever,=respondents l to 3 have failed to develop<\/p>\n<p>iuhiSchedule%&#8221;a&#8221; property in accordance with the<\/p>\n<p>l\ufb02evelopment Agreement and virtually abandoned the<\/p>\n<p>wproject. The claim of the petitioner is that she<\/p>\n<p>A&#8221;~has spent Rs.7 lakhs to make 2 apartment that<\/p>\n<p>belonged to her habitable although it was the<\/p>\n<p>obligation of the 15g and 3rd respondents to completej\ufb01g<\/p>\n<p>5 CM? 127\/O8<\/p>\n<p>the 2 apartments in all respects and deliver it to<br \/>\nher. Since the dispute has arisen between Dthe<br \/>\npetitioner on one hand and the respondents i 3nd gen<br \/>\non the other hand, notice was issned a_oopv of vhioh 2<br \/>\nis produceds as Annexure&#8211;&#8220;B&#8221; invoking V\ufb01\ufb01ep=arpitral#<br \/>\nclause to appoint an arbitrator rto resolve \ufb02tha\ufb01x<br \/>\ndisputes. Three names ot7:the&#8217; Arbitpatorsiiwere<br \/>\nsuggested. It appears that {ha gespgndents have not<\/p>\n<p>responded to the said noticei&#8221; Hence this petition.<\/p>\n<p>2. Notice }was.horderedf to &#8220;the respondents.<br \/>\nRespondents ,;;rfg &#8216;and %\u00a7a%\u00a3O 38 have put their<br \/>\nappearange. _hdesRespondent _;No.3 is served and<\/p>\n<p>unrepresented,<\/p>\n<p>3\u00a7'&#8221;rnThe &#8216;learned counsel for the petitioner<\/p>\n<p>zgsobmits that since there is an Arbitral Clause, an<\/p>\n<p>Arbitrator .is Vrequireds to be appointeds to resolve<\/p>\n<p>Vi the dispotephetween the parties.<\/p>\n<p>4.&#8221;v_&#8217;\u00a3he learned counsel for the respondents<\/p>\n<p>\u00absubmits that the agreement was entered into between<\/p>\n<p>i~ the parties in the year 1995 and hence invoking the<\/p>\n<p>hp&#8217; .pV I I \/\ufb02<br \/>\n&#8216;._MArbitral Clause does not arise. jg?<\/p>\n<p>6 CMP 127\/08<\/p>\n<p>5. Apparently, it is to be noticed that the<\/p>\n<p>Agreement was entered into between the parties. in<\/p>\n<p>the year l995. The perusal of the KAgreement .<\/p>\n<p>discloses that there is EH1 Arbitral Clause, kwhich &#8221;<\/p>\n<p>would, indicate that if any dispute farises&#8221;-hetweent<\/p>\n<p>the parties to the Agreement, it is required to be_ ;<\/p>\n<p>decided under the Indian iArhitration: Act: l94G.<br \/>\nIndeed, as on the vdate jwheniithea Agreement was<br \/>\nentered into, the Indian Arhitration Act 1940 was on<br \/>\nthe statute and the same isVre\u00a7laced by l996 Act.<br \/>\nSince the proceedingS are to be initiated under the<br \/>\nnew Act, :ne,\u00a7re\u00a7\u00e9\ufb01:\u00abpe\u00a7iti5h~i\u00a7 filed. Indeed, it<br \/>\nis to her noticed\ufb01 thatg when the proceedings are<\/p>\n<p>initiated under the 1995 Act, notice is required to<\/p>\n<p>_be issued[~ In this case, notice is issued and the<\/p>\n<p>Asame*is not responded within 30 days. Even under<\/p>\n<p>Section s67\u00a2f_\u00e9b\u00e9 1996 Act it envisages that the new<\/p>\n<p>VAct shall apply to the Arbitral proceedings, which<\/p>\n<p>A&#8221; commences on or after this Act come into force.<\/p>\n<p>&#8216;,6. The petitioner will have to file a petition<\/p>\n<p>uunder Section 11 of the Act before this Court.<\/p>\n<p>\ufb01aving regard to the tact that the Indian<\/p>\n<p>Arbitration Act 1940 is no longer on the statute and<\/p>\n<p>\/<\/p>\n<p>7 CMP 12?\/O8<\/p>\n<p>the same is replaced by the Arbitration and<br \/>\nConciliation.
