SHAH\n\t\t\n\t\n\n \n\nDate\n: 09\/09\/2010 \n\n \n\nORAL\nORDER<\/pre>\n<p>1.\t\tBy<br \/>\nway of this petition under Article 226 of the Constitution of India,<br \/>\nthe petitioner has prayed for an appropriate writ, order and\/or<br \/>\ndirection, quashing and setting aside the judgement and award dated<br \/>\n28\/03\/2002 passed by Labour Court, Rajkot in Reference (LCR) No.799<br \/>\nof 1990 in awarding only Rs.25,000\/- towards compensation in lieu of<br \/>\nreinstatement and backwages.\n<\/p>\n<p>2.\t\tMr.Kishor<br \/>\nPaul, learned advocate appearing on behalf of the petitioner has<br \/>\nsubmitted that in the facts and circumstances of the case, the amount<br \/>\nof compensation awarded by the Labour Court is too meager and the<br \/>\npetitioner is ready and willing to accept a total sum of<br \/>\nRs.1,00,000\/- towards compensation in lieu of reinstatement and<br \/>\nbackwages.\n<\/p>\n<p>3.\t\tMr.Sunil<br \/>\nJoshi, learned advocate, under the instruction received from the<br \/>\nrespondent, has stated at the bar that the respondent is ready and<br \/>\nwilling to pay a further sum of Rs.25,000\/- to the petitioner towards<br \/>\ncompensation in lieu of reinstatement and backwages.\n<\/p>\n<p>4.\t\tIn<br \/>\nview of the above difference between Rs.1,00,000\/- and Rs.50,000\/-<br \/>\nbetween the respective parties, learned advocates appearing on<br \/>\nbehalf of the respective parties ultimately left it to the Court to<br \/>\ndecide an amount of compensation to be paid to the petitioner in lieu<br \/>\nof reinstatement and backwages.\n<\/p>\n<p>5.\t\tUnder<br \/>\nthe circumstances and considering the fact that the petitioner came<br \/>\nto be dismissed in the year 1990 and such termination was found to be<br \/>\nillegal, this Court is of the opinion that if a further sum of<br \/>\nRs.40,000\/- is directed to be paid to the petitioner (in all<br \/>\nRs.65,000\/- towards compensation in lieu of reinstatement and<br \/>\nbackwages), it will put an end to the litigation between the parties.\n<\/p>\n<p>6.\t\tUnder<br \/>\nthe circumstances, impugned judgement and award dated 28\/03\/2002<br \/>\npassed by Labour Court, Rajkot in Reference (LCR) No.799 of 1990 is<br \/>\nhereby modified to the extent that the petitioner shall be paid total<br \/>\na sum of Rs.65,000\/- towards compensation in lieu of reinstatement<br \/>\nand backwages. It is reported that a sum of Rs.25,000\/0 is already<br \/>\npaid to the petitioner and, therefore, now the respondent to pay a<br \/>\nsum of Rs.40,000\/- to the petitioner within a period of eight weeks<br \/>\nfrom today. Rule is made absolute to the aforesaid extent.
