 An\ufb01exure ‘A2’ dt. 20.10.2001 by holding that Annexure<\/p>\n

\nPension sanctioned to the Applicant under Annexure –<\/p>\n

pursuant to Annexure — A2, the “same  to V.<\/p>\n

\nTribunal contending that he<\/p>\n
hadput in Vinore than 36 years of service with the<\/p>\n
  responrderityp and h’e’Was promoted as FDA on 18.5.1985.<\/p>\n
    the age of superannuation and retired<\/p>\n
 His pension was fixed as per Annexure<\/p>\n
  at.c__ARs.3,9OO\/– p.rn. Consequently, on the basis of<\/p>\n
 DCRG and Fmnily Pension to which the family<\/p>\n

However, by order dt. 20.10.2001, the pension graiited<\/p>\n
was reduced from Rs.39OO to Rs.3,800. H<\/p>\n

Rs.5,829\/- on the ground that the pprorriotiont <\/p>\n
applicant as FDA was subject_it’o:the \ufb01nal’-s_eVnio_r’5ity list of
\nFDA. Wherefore, theretpwas   calculation of
\npension as per  Application was
\nresistedl”‘b3r.V.p:thelV’:p:etition”e’rs lheiein contending that the
\npromoti.on.’_ of  as FDA on 18.5.1985 was<\/p>\n
subject toi’the’fi.nalia’ation of the seniority list of FDA and<\/p>\n
 f?inaii..znation’,””i’t”Was found that the applicant was<\/p>\n
 noteligihlel”foijpromotion as FDA w.e.f. 18.5.1985 and<\/p>\n
 mistake that has occurred in Annexure<\/p>\n
 ‘A1’ u}hil3e \ufb01xing the pension, DCRG and family pension<\/p>\n

has sought to be corrected as per Annexure ‘A2’ which<\/p>\n
is passed in accordance with law.\n<\/p>\n

\nwithout any  him. Having
\nregardtothei;proiii’s;ion$”-of Kariiataka Civil Service Rules
\n{Autoriiatic  promotion to the senior<\/p>\n
sca1C_0f pay)” R1ileiS*,._s  the applicant was granted<\/p>\n
  atiitor\ufb02\ufb01itic-. .grant”of”‘sVpecial promotion to senior scale of<\/p>\n
  of the pay scale of the Applicant being<\/p>\n
anger the” mentioned in the schedule of the Rules<\/p>\n
 A1991″. v.V__iThe applicant retired from service on attaining<\/p>\n
theiage of superannuation on 30.6.2001. Wherefore,<\/p>\n
the pension, DCRG and Famiiy pension were \ufb01xed as<\/p>\n
per Annexure ‘Al’ was justified. The same should<\/p>\n

\nand held that appiicant is entitled to pension as<\/p>\n
granted at Annexure ‘A1’ dt. 14.9.2001. <\/p>\n
ordered that in the event of any recovery  <\/p>\n
Annexure ‘A2’ same shall have to be to ”<\/p>\n
applicant with interest thereon at 9-1% the-..da.te<\/p>\n
of recovery till the paymer_1t*.-._. Time for ‘e_orn_p1ia.nce off’<\/p>\n

\ngranted. Being aggrieved   order of the<\/p>\n

    respondent and respondent has appeared<\/p>\n

5. Learned Government advocate appearingfor<\/p>\n
the petitioners submitted that since the promotio–nFof*
\nthe respondent to the post of FDA from  d’
\nsubject to final seniority list to be p’ubiishe5d  cxadrie <\/p>\n
of FDA and after publication of ‘seniority <\/p>\n
the cadre of FDA, it was foundetjhat he ‘was.<\/p>\n
to promotion from 18..5.*1.985i;”Wwherefore. ‘the Ofder as<\/p>\n
per Annexure ‘A2’ dt.   correct the
\nmistake that   the pension,
\nDCRG and    ‘Anr1exure ‘A1’ dt.\n<\/p>\n
 i\u00e9iot justified in setting
\naside   implementation of the<\/p>\n
pension,  and  pension quantified as per<\/p>\n
   dt.  and ordered for refund of<\/p>\n
  with interest.\n<\/p>\n

6. We have given careful consideration to the
\ncontention of the learned Government Advocate”‘~.and<\/p>\n
scrutinized the material on record.<\/p>\n

is entitled to superannuation pension of  <\/p>\n
w.e.f. 1.7.2001, DCRG of Rs.1,_2.8,.7()0\/~45’i’n*:ii;ttipv’_’su:n R<\/p>\n
and in the event of his dezath;-Sitheiivspoiisie <\/p>\n
Neelamma will be  of-L’<\/p>\n
Rs.1,560\/– and comm.utatio.nVVV:of. pension’ of  1,300\/–
\nout of pension of 176\/ ~, is justi\ufb01ed<\/p>\n
