Justice M.SASIDHARAN NAMBIAR\n\n Dated :25\/11\/2010\n\n O R D E R\n          M.SASIDHARAN NAMBIAR,J.\n\n           ---------------------------------------------\n           CRL.M.C.NO.4030 OF 2010\n           ---------------------------------------------\n           Dated        25th    November, 2010\n\n\n                          O R D E R\n<\/pre>\n<p>         Petitioner was third accused in<\/p>\n<p>C.C.420\/2007 on the file of Judicial First<\/p>\n<p>Class Magistrate&#8217;s Court-I, Hosdurg.                           As<\/p>\n<p>he  was   absconding, case against him was<\/p>\n<p>re-filed as C.C.230\/2009 and remaining four<\/p>\n<p>accused   were         tried             by        the    learned<\/p>\n<p>Magistrate. By Annexure-A2 judgment those<\/p>\n<p>accused were acquitted. Petition is filed<\/p>\n<p>under  Section       482        of       Code        of  Criminal<\/p>\n<p>Procedure  to      quash           C.C.230\/2009           pending<\/p>\n<p>against him, contending that in view of the<\/p>\n<p>order of acquittal of the co-accused and<\/p>\n<p>settlement of the dispute with respondents<\/p>\n<p>1 and 2, it is not in the interest of<\/p>\n<p>justice to continue the prosecution.<\/p>\n<p>Crmc 4030\/10<br \/>\n<span class=\"hidden_text\">                          2<\/span><\/p>\n<p>            2. Learned  counsel appearing for the<\/p>\n<p>petitioner, respondents 1 and 2 and learned<\/p>\n<p>Public Prosecutor were heard.<\/p>\n<p>            3. Annexure-A1   final   report   and<\/p>\n<p>Annexure-A2 judgment in C.C.420\/2007 show that<\/p>\n<p>prosecution      case is  that  the  five accused<\/p>\n<p>formed themselves into an unlawful assembly on<\/p>\n<p>17\/2\/2007 with the common object of attacking<\/p>\n<p>respondents 1 and 2 and in furtherance of the<\/p>\n<p>common      object, at  about 6.30  p.m, attacked<\/p>\n<p>respondents       1  and    2   after   wrongfully<\/p>\n<p>restraining them and voluntarily caused hurt to<\/p>\n<p>them and thereby committed the offences under<\/p>\n<p>Sections 143,147, 341 and 323 read with section<\/p>\n<p>149 of Indian Penal Code. Annexure-A2 judgment<\/p>\n<p>also show that when the remaining accused were<\/p>\n<p>tried by the learned Magistrate, none of the<\/p>\n<p>prosecution witness supported the prosecution<\/p>\n<p>Crmc 4030\/10<br \/>\n<span class=\"hidden_text\">                           3<\/span><\/p>\n<p>case, evidently because of the settlement with<\/p>\n<p>the       accused.   Joint    petition   filed    by<\/p>\n<p>respondents      1  and  2  along  with  petitioners<\/p>\n<p>establishes that they have settled the dispute<\/p>\n<p>with the petitioners also and consequent to the<\/p>\n<p>settlement,      there   is  no   likelihood  of   a<\/p>\n<p>successful prosecution, even if, petitioner is<\/p>\n<p>to be tried. In such circumstances, as held by<\/p>\n<p>the Apex Court in       <a href=\"\/doc\/1442974\/\">Madan Mohan Abbot v. State<\/p>\n<p>of Punjab<\/a> (2008 (3) KLT 19 (SC), it is not in<\/p>\n<p>the     interest    of  justice   to  continue   the<\/p>\n<p>prosecution.\n<\/p>\n<p>            Petition is allowed.
