Justice K.T.SANKARAN\n\n Dated :19\/01\/2010\n\n O R D E R\n                           K.T.SANKARAN, J.\n              ------------------------------------------------------\n                        B.A. NO. 6025 OF 2009\n              ------------------------------------------------------\n            Dated this the 19th day of January, 2010\n\n\n                                 O R D E R\n<\/pre>\n<p>      This is an application for anticipatory bail under Section 438 of<\/p>\n<p>the Code of Criminal Procedure. Petitioners are accused Nos.1 to 9<\/p>\n<p>in Crime No.272 of 2009 of Pazhayangadi Police Station, Kannur<\/p>\n<p>District.\n<\/p>\n<\/p>\n<p>      2.   The offences alleged against the petitioners are under<\/p>\n<p>Sections 143, 147, 148, 323, 324 and 308 read with Section 149 of<\/p>\n<p>the Indian Penal Code.\n<\/p>\n<\/p>\n<p>      3. The prosecution case is that on 6.10.2009, there was a<\/p>\n<p>clash between members of two political parties and the petitioners<\/p>\n<p>committed the offence. It is submitted that Crime Nos.271 and 272<\/p>\n<p>of 2009 were registered in respect of the offence committed by the<\/p>\n<p>different political groups at different hours on the same day.<\/p>\n<p>      4. The de facto complainant has sustained fracture of left<\/p>\n<p>tibia. The allegation is that the first accused caused the injury by<\/p>\n<p>B.A. NO. 6025 OF 2009<\/p>\n<p>                                    :: 2 ::\n<\/p>\n<p>beating with an iron pipe.     The injury sustained by the de facto<\/p>\n<p>complainant is not attributable to any of the overt acts allegedly<\/p>\n<p>committed by accused Nos.2 to 9.\n<\/p>\n<\/p>\n<p>       5. Taking into account the facts and circumstances of the<\/p>\n<p>case, I am not inclined to grant anticipatory bail to the first petitioner<\/p>\n<p>(first accused). Custodial interrogation of the first accused may be<\/p>\n<p>required in the case.     If anticipatory bail is granted to the first<\/p>\n<p>accused, it would adversely affect the proper investigation of the<\/p>\n<p>case.    However, I am of the view that anticipatory bail can be<\/p>\n<p>granted to petitioners 2 to 9 (accused Nos.2 to 9), in the facts and<\/p>\n<p>circumstances of the case.\n<\/p>\n<\/p>\n<p>       6. There will be a direction that in the event of the arrest of<\/p>\n<p>petitioners 2 to 9 (accused Nos.2 to 9), the officer in charge of the<\/p>\n<p>police station shall release them on bail on their executing bond for<\/p>\n<p>Rs.15,000\/- each with two solvent sureties for the like amount to the<\/p>\n<p>satisfaction of the officer concerned, subject to the following<\/p>\n<p>conditions:\n<\/p>\n<p>B.A. NO. 6025 OF 2009<\/p>\n<p>                                     :: 3 ::\n<\/p>\n<\/p>\n<p>      a)      Petitioners 2 to 9 (accused Nos.2 to 9) shall report<br \/>\n              before the investigating officer between 9 A.M. and 11<br \/>\n              A.M. on alternate Sundays, till the final report is filed or<br \/>\n              until further orders;\n<\/p>\n<p>      b)      Petitioners 2 to 9 (accused Nos.2 to 9) shall appear<br \/>\n              before the investigating officer for interrogation as and<br \/>\n              when required;\n<\/p>\n<p>      c)      Petitioners 2 to 9 (accused Nos.2 to 9) shall not try to<br \/>\n              influence the prosecution witnesses or tamper with the<br \/>\n              evidence;\n<\/p>\n<p>      d)      Petitioners 2 to 9 (accused Nos.2 to 9) shall not commit<br \/>\n              any offence or indulge in any prejudicial activity while on<br \/>\n              bail;\n<\/p>\n<p>      e)      In case of breach of any of the conditions mentioned<br \/>\n              above, the bail shall be liable to be cancelled.<\/p>\n<p>      The Bail Application is dismissed in so far as it relates to the<\/p>\n<p>first petitioner (accused No.1) and it is allowed in the manner<\/p>\n<p>indicated above, in so far as it relates to petitioners 2 to 9 (accused<\/p>\n<p>Nos.2 to 9).\n<\/p>\n<\/p>\n<p>                                                    (K.T.SANKARAN)<br \/>\n                                                            Judge<br \/>\nahz\/<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court M.K.
