K. Maruthi Rao,\nRespondent           -      Central Reserve Police Force, Warangal\n\n\nFacts<\/pre>\n<p>:\n<\/p>\n<p>      By an application of 27.2.07 Shri N. K. Maruthi Rao, Advocate of Adarsh<br \/>\nColony, Belgaum, Karnataka applied to the Comdt. 83 Bn. CRPF, Mangapet (AP)<br \/>\nseeking the following information:\n<\/p>\n<p>   1. &#8216;Copy of the documents along with related correspondence<br \/>\n      regarding tracing of missing person named Shri Ningappa<br \/>\n      Siddappa Arabhavi number 941380544 CT\/GD husband of Smt.<br \/>\n      Roopa.\n<\/p>\n<p>   2. Copy of his service register.\n<\/p>\n<p>   3. His present residential address and address of place of work.\n<\/p>\n<p>   4. Correspondence made regarding allotment of quarter to him at<br \/>\n      police station Mangapet.&#8221;\n<\/p>\n<p>      The letter sent to the Warangal (AP) address was returned to him with<br \/>\nremarks that he is now stationed in J&amp;K. Complaining that, &#8220;The complainant<br \/>\nsubmitted the application to the respondent to the Jammu and Kashmir address<br \/>\non 21.3.2007. There is no reply from the respondent even up to this day and the<br \/>\nrespondent was under obligation to supply the information within 48 hours&#8221;, Shri<br \/>\nMaruthi Rao pursuing this matter for his client Smt. Roopa Ningappa Arabhavi<br \/>\nsubmitted a complaint to this Commission with the following prayer:\n<\/p>\n<blockquote><p>         &#8220;Complainant humbly prays to direct the respondent and the<br \/>\n         concerned officials to supply the information about the missing staff<br \/>\n         of his establishment Shri Ningappa Siddappa Arabhavi No.<br \/>\n         941380544 CT\/GD in the interest of justice. The opponent may<br \/>\n         kindly be punished as per law for violating the provisions of Right to<br \/>\n         Information Act, 2005.&#8221;<\/p><\/blockquote>\n<p>     In response to our appeal notice, Shri D. Bhattacharya, Comdt. 83 Bn. In his<br \/>\nletter of 21.6.08, received in this Commission on 7.7.08, has submitted as<br \/>\nfollows:\n<\/p>\n<p><span class=\"hidden_text\">                                                1<\/span><\/p>\n<blockquote><p>        &#8220;(b)   The application in question was sent to the commandant 83<br \/>\n              BN, CRPF, at Srinagar (J&amp;K). The controlling authority of<br \/>\n              whom, the DIGP is available at Rangareddy (AP) and the<br \/>\n              authority designated to process the case, the Addl. DIGP<br \/>\n              (Adm), Southern Sector Headquarter, CRPF is at Hyderabad<br \/>\n              and the authority competent to decide the case, the Addl.<br \/>\n              DIGP (Adm) Directorate General is at New Delhi. Hence,<br \/>\n              the delay in processing the case took place.\n<\/p><\/blockquote>\n<blockquote><p>       (c)    CRPF has been exempted from applicability of the general<br \/>\n              provisions of the RTI Act, 2005 by virtue of its inclusion in<br \/>\n              second schedule. Moreover, the application ibid does not<br \/>\n              contain any thing pertaining to corruption violation or human<br \/>\n              rights. Hence, the CRPF is not bound to give the information<br \/>\n              even under the exception clause inserted in section 24 (1) of<br \/>\n              the RTI Act, 2005.&#8221;<\/p><\/blockquote>\n<p>     He has also outlined what he describes as &#8220;many important steps&#8221; to<br \/>\nprovide every facility to Smt. Roopa Nangappa Siddappa Arabhavi .\n<\/p>\n<p>     The appeal was heard on 12.2.2009 through video conferencing.             The<br \/>\nfollowing are present:\n<\/p>\n<p>Respondents<br \/>\nat CIC Studio, New Delhi.\n<\/p>\n<p>             Sh. S. R. Ojha, DIC<br \/>\n             Sh. Y. N. Rai, Dy. Comdt.\n<\/p>\n<p>at NIC Studio, Hyderabad<br \/>\n             Sh. Ramanuj, CPIO South Sector, CRPF<br \/>\n             Sh. Sanjay Kaushik, DIG Group Centre, Kandareddy<br \/>\n             Sh. Bala Krishna Ram, Dy. Cmdt. Southern Sector<\/p>\n<p>     Shri N. K. Maruthi Rao, Advocate when contacted on telephone submitted<br \/>\nthat he left it to the Commission to take a decision on merits. Respondent Shri<br \/>\nSanjay Kaushik DIG submitted that this application does not amount to allegation<br \/>\nof Human Rights violation since the concerned Constable Shri Ningappa<br \/>\nSiddappa Arabhavi number 941380544 CT\/GD went missing on having left the<br \/>\nBattalion for a meal at his home from which he did not return. Upon receiving<br \/>\nthis information the Battalion itself had treated him as absconding and registered<br \/>\nan FIR at the local police station. Shri S. R. Ojha, DIG added to this by informing<br \/>\nthe hearing that a Writ Petition had been filed before the High Court in this matter<\/p>\n<p><span class=\"hidden_text\">                                         2<\/span><br \/>\n in which the local police have informed the Hon&#8217;ble High Court that Shri Arabhavi<br \/>\nhad been found dead in Goa.\n<\/p>\n<p>      On the question of failure to respond to the RTI application Shri Ojha<br \/>\nsubmitted a copy of a letter of 9.4.07 from CPIO Shri Ramesh Chandra, ADIGP<br \/>\n(Admn) Directorate General, CRPF informing Shri Rao as follows:\n<\/p>\n<blockquote><p>       &#8220;As per Section 24(i) of Right to Information Act, 2005, Central<br \/>\n       Police Forces as listed in the Second Schedule of the Act, have<br \/>\n       been given qualified exemption from the Act in so far as the<br \/>\n       allegations of other than connected with Human Right Violations<br \/>\n       and Corruption. From the facts of the case mentioned in your<br \/>\n       application cited above, there appears to be no violations of Human<br \/>\n       Rights as well as facts of the case do not attract ingredients to<br \/>\n       constitute the allegations of corruption. Hence the information<br \/>\n       sought vide your application is not tenable under Right to<br \/>\n       Information Act, 2005.&#8221;\n<\/p><\/blockquote>\n<blockquote><p>                            DECISION NOTICE<\/p>\n<p>      In light of the above, no case is made out of allegation of any human rights<br \/>\nviolation by the CRPF, an organization listed at Sr. No. 10 of the Second<br \/>\nSchedule as amended from time to time. It also stands established that the<br \/>\nrequest of applicant Shri N. K. Maruthi Rao was responded to in time.<\/p><\/blockquote>\n<p>     The CRPF being an organization not covered by the RTI Act, 2005 as<br \/>\ndetermined by Section 24 sub-section (1) of that Act, we find that the present<br \/>\ncomplaint cannot be sustained and is hereby dismissed.
