The State Of Bihar through Secretary, Urban Development Department, Patna.\n    2. The Ara Municipal Corporation, through Municipal Commissioner (Nagar Aukta), Ara.\n    3. The Municipal Commissioner (Nagar Aukta), Ara Municipal Corporation, Ara.\n    4. Bharat Sah, Son of name not known to the petitioner, Resident of Village Majhaua, PS Ara\n       Town, District Bhojpur. ------ Respondents.\n                                            -----------\n<\/pre>\n<p>4       3.11.2011                    The order impugned is rather vague as<\/p>\n<p>                          it appears that it does not really clarify the<\/p>\n<p>                          disputes in question.             The question is whether<\/p>\n<p>                          Plot No. 1731 (1721) is a public road or a<\/p>\n<p>                          private road.\n<\/p>\n<p>                                     The petitioner had made an allegation<\/p>\n<p>                          that      the     private       respondent           was   making<\/p>\n<p>                          construction on the lane which is according to<\/p>\n<p>                          the    order     of     the   Municipal       Commissioner        a<\/p>\n<p>                          private road.\n<\/p>\n<p>                                     Learned counsel for the respondents on<\/p>\n<p>                          the    other     hand     submits      that     he    is   making<\/p>\n<p>                          construction on his own land which is Plot No.<\/p>\n<p>                          1725 and as such, the petitioner cannot make<\/p>\n<p>                          any complaint with respect to encroachment as<\/p>\n<p>                          he is not encroaching upon her land or the land<\/p>\n<p>                          on which the alleged road is situated.<\/p>\n<p>                                     It goes without saying that if it is a<\/p>\n<p>                          private land, no encroachment proceeding would<\/p>\n<p>                          lie, however, if the road is a public road then<br \/>\n<span class=\"hidden_text\">                          2<\/span><\/p>\n<p>         obviously    encroachment       proceedings         can   be<\/p>\n<p>         initiated if it is found that the petitioner<\/p>\n<p>         has made construction over the public road.
