By<br \/>\n\tconsent of the parties and in peculiar facts and circumstances, the<br \/>\n\tappeal is heard for final disposal at the admission stage.\n<\/p>\n<p>\t   It<br \/>\n\twas submitted by learned counsel, Mr.Upadhyay, that the interviews<br \/>\n\theld by the opponent herein are being concluded tomorrow resulting<br \/>\n\tinto permanent loss of opportunity for the appellant to appear at<br \/>\n\tthe interview, even if he were to succeed in the main petition. It<br \/>\n\twas further submitted that the refusal to grant interim relief,<br \/>\n\tsubject to all the necessary conditions and clarifications, amounted<br \/>\n\tto rejection of the main petition in so far as the petition would<br \/>\n\tbecome practically infructuous after the last opportunity of<br \/>\n\tappearing at the interview is lost.\n<\/p>\n<p>\t   Learned<br \/>\n\tcounsel, Mr.Shukla, appearing for the respondent,  vehemently argued<br \/>\n\tthat the appellant was caught in a copy case and even the marks of<br \/>\n\this written examination were not assessed on that account.<br \/>\n\tTherefore, even without assessment of the marks of the written test<br \/>\n\tand without securing qualifying marks for the interview, the<br \/>\n\tappellant could not be given an opportunity of appearing at the<br \/>\n\tinterview. He also submitted that in case of a special direction of<br \/>\n\tthis Court in the main petition, the respondent could arrange<br \/>\n\tspecial interview for the appellant if he succeeds in the main<br \/>\n\tpetition, in spite of the fact that the Expert Committee of the<br \/>\n\trespondent has already opined that the appellant appeared to have<br \/>\n\tindulged in unfair practice at the time of written examination.\n<\/p>\n<p>\t      Since<br \/>\n\tthe main writ petition is pending before learned Single Judge and it<br \/>\n\tis required to be heard and expeditiously disposed on merits, it<br \/>\n\twould be unnecessary and improper for us to express any opinion on<br \/>\n\tthe merits of the contentions of the parties in the main petition.<br \/>\n\tIt was, however, clear that once the appellant were to lose the<br \/>\n\topportunity of appearing at the interview, it would be extremely<br \/>\n\tdifficult, if not impossible, to arrange an interview for the<br \/>\n\tappellant alone. As submitted and conceded by learned counsel,<br \/>\n\tMr.Upadhyay,  result of the appellant&#8217;s interview, if it is taken,<br \/>\n\tneed not be declared, till the other hurdles of assessment of the<br \/>\n\twritten papers, securing of qualifying marks and removal of his<br \/>\n\tdis-qualification on account of the copy case were successfully<br \/>\n\tcrossed.\n<\/p>\n<p>\t         In<br \/>\n\tthe above peculiar facts and circumstances, it appears to be<br \/>\n\tnecessary and just to direct the respondent to allow the appellant<br \/>\n\tto appear at the interview and not to disclose result of the<br \/>\n\tinterview till final hearing and disposal of the pending petition of<br \/>\n\tthe appellant. Accordingly,  the impugned order is set aside and the<br \/>\n\toriginal Civil Application No.3719 of 2010 in Special<br \/>\n\tCivil Application  No.5432 of 2009  is partly allowed with<br \/>\n\tthe direction that the respondent authority shall permit the<br \/>\n\tappellant herein to appear at the interview to be held pursuant to<br \/>\n\tadvertisement No.87\/2006-07, subject to outcome of the main petition<br \/>\n\tand with the clarification that grant of such relief by way of<br \/>\n\tinterim relief shall not influence either the interview in which the<br \/>\n\tappellant may be permitted to appear  or the outcome of the main<br \/>\n\tpetition which is pending before learned Single Judge.
