DAVE\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 22\/03\/2011 \n\n \n\nORAL\nORDER<\/pre>\n<p>Rule.\n<\/p>\n<p>\tLearned APP waives service of rule.\n<\/p>\n<p>Learned Senior Advocate appearing<br \/>\n\tfor the applicant submits that investigation<br \/>\n\tis over and charge sheet is filed and allegations levelled in the<br \/>\n\tFIR have no basis and during the course of investigation also<br \/>\n\tnothing surfaces on record in support of such allegations.  It is<br \/>\n\tfurther submitted that immediately after the incident, the victim<br \/>\n\twas admitted in one of the best hospitals of the Rajkot City.  It is<br \/>\n\talso submitted that earlier efforts were made to enter into<br \/>\n\tcompromise by the intervention of caste and community leaders, where<br \/>\n\talso no complaint or grievance was made as such.  It is<br \/>\n\tfurther submitted that the applicant will not flee from<br \/>\n\tjustice and will cooperate with the investigation as and when called<br \/>\n\tfor. It is further submitted that by imposing suitable conditions,<br \/>\n\tthe applicant may be enlarged on bail.\n<\/p>\n<p>Heard learned APP  for the<br \/>\n\trespondent &#8211; State.\n<\/p>\n<p>Having<br \/>\n\theard learned counsel for the parties and perusing the record of the<br \/>\n\tcase and taking into consideration the facts of the case, nature of<br \/>\n\tallegations, role attributed to the accused and punishment<br \/>\n\tprescribed for the alleged offences coupled with the fact that<br \/>\n\tcharge sheet is filed, without discussing the evidence in<br \/>\n\tdetail, at this stage, I am inclined to enlarge the applicant on<br \/>\n\tbail  in connection with C.R.No.I-33\/2010 of Mahila Police Station,<br \/>\n\tRajkot for the offences punishable under sections 498-A, 306 &amp;<br \/>\n\t114 of the Indian Penal Code and under sections 4 &amp; 5 of the<br \/>\n\tDowry Prohibition Act, on furnishing   bond of Rs.10,000\/- (Rupees<br \/>\n\tten thousand only) with one surety of the like amount to the<br \/>\n\tsatisfaction of the lower Court and on conditions that the applicant<br \/>\n\tshall :\n<\/p>\n<p>[a]\tnot<br \/>\ntake undue advantage of liberty or abuse liberty;\n<\/p>\n<p>[b]\tnot<br \/>\nact in a manner injurious to the interest of the prosecution;\n<\/p>\n<p>[c]\tmaintain<br \/>\nlaw and order;\n<\/p>\n<p>[d]\tmark<br \/>\npresence before the concerned  Police Station on every 1st<br \/>\nand 15th day of English Calender month between  11.00 a.m.<br \/>\nand 2 p.m .\n<\/p>\n<p>[e]\tnot<br \/>\nleave the State of Gujarat without prior permission of the Sessions<br \/>\n\tJudge concerned;\n<\/p>\n<p>[f]\tfurnish<br \/>\nthe address of residence at the time of execution of the \tbond and<br \/>\nshall not change the residence without prior permission of  this<br \/>\nCourt;\n<\/p>\n<p>[g]\tsurrender<br \/>\npassport, if any, to the Lower Court immediately.\n<\/p>\n<p>If<br \/>\n\tbreach of any of the above conditions is committed,  the Sessions<br \/>\n\tJudge concerned will be free  to take appropriate action in the<br \/>\n\tmatter.\n<\/p>\n<p>Bail<br \/>\n\tbefore the Lower Court having jurisdiction to try the case.\n<\/p>\n<p>Rule<br \/>\n\tis made absolute.
