Lal Bihari Sah\n                                      Versus\n                                 STATE OF BIHAR\n                                      ------\n<\/pre>\n<p>2\/      27.01.2011               Heard learned counsel for the petitioners and learned<\/p>\n<p>                     counsel for the State.\n<\/p>\n<p>                                 Petitioners are alleged for cutting of soil from Bandh is<\/p>\n<p>                     denied on the ground that the soil from bank of the river thrown in<\/p>\n<p>                     petitioners&#8217; field was only leveled. Taking which into consideration,<\/p>\n<p>                     two of the co-accused persons namely, Madan Sah and Abhay Sah<\/p>\n<p>                     are allowed bail vide Cr. Misc. No. 26555 of 2010 though in regular<\/p>\n<p>                     side.\n<\/p>\n<p>                                 Considering the facts and circumstance of the case,<\/p>\n<p>                     prayer of the petitioners is allowed.\n<\/p>\n<p>                                 In the event of arrest or surrender within one month<\/p>\n<p>                     from the date of receipt\/production of a copy of this order in<\/p>\n<p>                     connection with Yogapatti P.S. Case No. 202 of 2010 above named<\/p>\n<p>                     petitioners shall be released on bail on furnishing bail bond of Rs.<\/p>\n<p>                     10,000\/- (ten thousand) each with two sureties of the like amount<\/p>\n<p>                     each to the satisfaction of C.J.M., Bettiah, West Champaran subject<\/p>\n<p>                     to the conditions as laid down under Section 438(2) of Cr.
