Justice A.K.BASHEER\n\n Dated :16\/12\/2008\n\n O R D E R\n                              A.K.BASHEER, J.\n             - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - -\n                        CRL.R.P.No.743 OF 2002\n             - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - -\n            Dated this the 16th day of December, 2008\n\n                                    O R D E R\n<\/pre>\n<p>      Petitioner, who has been concurrently found guilty by<\/p>\n<p>the trial court as well as the appellate court under Section<\/p>\n<p>138 of    the    Negotiable Instruments Act, has preferred this<\/p>\n<p>revision petition. The trial court had convicted and sentenced<\/p>\n<p>the petitioner to undergo simple imprisonment for 6 months<\/p>\n<p>and to pay a sum of Rs.9,800\/= under Section 357(3) of the<\/p>\n<p>Code    of   Criminal        Procedure           to     the         complainant     as<\/p>\n<p>compensation.        In appeal, the               substantive sentence            was<\/p>\n<p>modified and reduced to simple imprisonment for one month.<\/p>\n<p>      2. Petitioner\/accused and the complainant have filed a<\/p>\n<p>petition under Section 147 of the Act stating that the matter<\/p>\n<p>has been compromised out of court and the complainant has<\/p>\n<p>received     the      entire money payable by the                           accused in<\/p>\n<p>connection with the above cheque transaction.                               Therefore,<\/p>\n<p>they pray    that     they may be permitted to                      compound       the<\/p>\n<p>offence.
