State  &amp; ors.\n<\/p>\n<pre>        Date of Order     :::    20\/10\/09\n\t\t\t\n     Hon'ble Mr. Justice Ajay Rastogi\n\nMr., Tej Prakash Sharma, for petitioner.\n\n<\/pre>\n<p>\tThe petitioner was promoted vide order Anx.2 dt. 22nd January, 2004 as Assistant Director against the vacancies of the year 1999-2000 on the basis of seniority-cum-merit. His grievance is that despite he being promoted vide order dated 02\/01\/2004, the consequential benefits, flowing from the order of promotion, have not been given effect to by the respondents which makes him eligible for promotion to the post of Deputy Director which is the higher post included in the Schedule appended to the Rajasthan Employment Exchange Service Rules, 1960. Counsel has further brought to the notice of this Court that one SS Choudhary, who has also been promoted along with him against the vacancies of 1999-2000, approached this Court by filing SB Civil Writ Petition No. 5397\/2004, Surendra Singh Choudhary Vs. State of Rajasthan &amp; Anr. before main seat of this Court at Jodhpur which was decided on 17\/10\/2006 directing as under:-\n<\/p>\n<p>Accordingly, this petition for writ deserves acceptance. The same, therefore, is allowed. The respondents are directed to give effect to the order of promotion dated 22\/01\/2004 by posting the petitioner as Assistant Director against the vacancies of the year 1999-2000.\n<\/p>\n<p>\tCounsel submits that once the petitioner has been promoted on the recommendations of the DPC as Assistant Director for the year 1999-2000, that certainly makes him entitled for further promotion on the post of Deputy Director under the Rules of 1960.\n<\/p>\n<p>\tWithout going into merits of the matter at this stage, this court considers it appropriate to direct the petitioner to make a fresh representation. If such representation is made within one month, the respondents shall decide the same by passing a speaking order in accordance with law within three months thereafter.
