Patel, learned advocate appearing for the petitioner submitted<br \/>\nthat a show cause notice came to be issued on 19.12.2007 and order of<br \/>\nexternment was passed on 9.11.09 by Sub Divisional Magistrate, Anjar.<br \/>\nIt is submitted that out of three cases, in two cases being Ist CR<br \/>\nNo. 17\/2000 and Ist CR No. 10 of 2007, the  petitioner was acquitted<br \/>\nvide orders dated 18.10.2006 and 18.3.2009, while one case being Ist<br \/>\nCR No. 31 of 2005 is pending for final disposal. The competent<br \/>\nauthority has not taken into consideration the acquittal of the<br \/>\npetitioner in two cases and, therefore, subjective satisfaction<br \/>\narrived at by the competent authority is vitiated and only on that<br \/>\nground alone, the petition requires to be allowed and the order<br \/>\n[Annexure:A] passed by the respondent no.3-Additional Secretary, Home<br \/>\nDepartment  be quashed and set aside.\n<\/p>\n<p>3.\tMr.\n<\/p>\n<p>D.C. Sejpal, learned APP representing the respondents, while opposing<br \/>\nthe petition submitted that the competent authority has taken into<br \/>\naccount the record of case and after going through the entire gamut<br \/>\nof the case, decided the matter and externed the petitioner vide<br \/>\norder dated 7.1.2010. It is submitted that there is no infirmity in<br \/>\nthe order passed by the Additional Secretary, Home Department and<br \/>\ntherefore, no interference is called for in the petition and the<br \/>\npetition is without any merits and deserves to be rejected.\n<\/p>\n<p>4.\tI<br \/>\nhave heard the learned advocates of both the sides at length and in<br \/>\ngreat detail. Considering the averments made in the  petition as well<br \/>\nas the order of externment passed by the respondent no.3-Additional<br \/>\nSecretary, Home Department which is referred to and relied upon by<br \/>\nboth the sides and produced at Annexure:A to the petition, it becomes<br \/>\nclear that respondent no.3-Additional Secretary, Home Department has<br \/>\nexterned the petitioner  for a period of six months for his<br \/>\ninvolvement in Ist CR No. 17 of 2000, Ist CR No. 31 of 2005 and Ist<br \/>\nCR No. 10 of 2007 and exercised powers under Section 56[a] of the<br \/>\nBombay Police Act, 1951.\n<\/p>\n<p>5.\tHowever,<br \/>\nthe competent authority has not considered the acquittal of the<br \/>\npetitioner in Ist CR No. 17 of 2000 by order dated 18.10.06 as well<br \/>\nas Ist CR No. 10 of 2007 by order dated 18.3.09, therefore,<br \/>\nsubjective satisfaction which was arrived at by the competent<br \/>\nauthority, in my view, is vitiated while passing the order of<br \/>\nexternment against the petitioner.\n<\/p>\n<p>6.\tIn<br \/>\nview of the above, the petition, in my view, is required to be<br \/>\nallowed only on that ground alone and the order of externment<br \/>\ndeserves to be quashed and set aside.\n<\/p>\n<p>7.\tFor<br \/>\nthe foregoing reasons, the petition is allowed. The  order of<br \/>\nexternment dated 7.1.2010 passed by respondent no.3-Additional<br \/>\nSecretary [Law and Order], Home Department is hereby quashed and set<br \/>\naside.
