Madhubani.\n                                             Versus\n                                     1. The State of Bihar\n                                        ------------------\n<\/pre>\n<p>02.   14.10.2011             Heard learned counsel for the petitioner and the<\/p>\n<p>                    State.\n<\/p>\n<p>                             The petitioner is apprehending his arrest in a<\/p>\n<p>                    case registered under Sections 363, 366A, 376 and 406 of<\/p>\n<p>                    the Indian Penal Code.\n<\/p>\n<p>                             It has been submitted that subsequent to the<\/p>\n<p>                    incriminating statement under Section 164 Cr.P.C. the<\/p>\n<p>                    alleged victim gave a petition before the Court that no<\/p>\n<p>                    such occurrence has taken place.\n<\/p>\n<p>                             Considering the same, let the petitioner, above<\/p>\n<p>                    named be released on provisional anticipatory bail for a<\/p>\n<p>                    period of two months in the event of arrest or surrender<\/p>\n<p>                    before the learned Court below within a period of four<\/p>\n<p>                    weeks from the date of receipt of the order on furnishing<\/p>\n<p>                    bail bond of Rs. 5,000\/- (Five Thousand) with two sureties<\/p>\n<p>                    of the like amount each or any other surety as fixed by the<\/p>\n<p>                    Court to the satisfaction of Chief Judicial Magistrate,<\/p>\n<p>                    Madhubani in connection with Kaluahi P.S. Case No. 39<\/p>\n<p>                    of 2011 subject to the conditions as laid down under<\/p>\n<p>                    Section 438(2) of the Code of Criminal Procedure as also<\/p>\n<p>                    subject to the following conditions:- (i) That one of the<br \/>\n<span class=\"hidden_text\">                               2<\/span><\/p>\n<p>           bailors will be a close relative of the petitioner who will<\/p>\n<p>           give an affidavit giving genealogy as to how he is related<\/p>\n<p>           with the petitioner. The bailor will also undertake to<\/p>\n<p>           inform the Court if there is any change in the address of<\/p>\n<p>           the petitioner.
