     This petition is for anticipatory bail.\n<\/p>\n
     2.   The alleged offences are under Sections 143, 147,<\/p>\n
148, 323, 324 and 308 read with Section 149 IPC. According to<\/p>\n
prosecution, on 24.8.2008, at about 6.30 p.m., petitioners<\/p>\n
(accused nos.1 to 4)        and another accused formed into an<\/p>\n
unlawful assembly and armed with deadly weapons, assaulted<\/p>\n
the defacto complainant and he sustained injuries. The accused<\/p>\n
used knife for the offence.\n<\/p>\n
     3.   Learned counsel for petitioners submitted that on the<\/p>\n
same day, defacto complainant and others were actually<\/p>\n
attacking petitioners and they sustained injuries at the hands of<\/p>\n
defacto complainant and others. For commission of the offence,<\/p>\n
chopper was used by the defacto complainant and first accused<\/p>\n
sustained an incised wound 10×2 cm. on the scalp with profuse<\/p>\n
bleeding, behind the left ear. Second accused sustained<\/p>\n
contusion on left knee and left eye lid. They were hospitalised<\/p>\n
and on the statement given by one of the accused, crime<\/p>\n

no.206\/08 was registered against defacto complainant.<\/p>\n
      4.    However, on knowing that the crime is registered<\/p>\n
against defacto complainant, he gave a statement exaggerating<\/p>\n
the incident. He has alleged that the accused committed the<\/p>\n
offence with intention to commit culpable homicide. But, the<\/p>\n
only injury sustained by the defacto complainant on an alleged<\/p>\n
attack made on him by five persons armed with deadly weapons<\/p>\n
is small superficial lacerated wound over abdomen. It is<\/p>\n
submitted that it is unlikely that such wound will be caused by<\/p>\n
the use of a knife as alleged.     On the other hand, the first<\/p>\n
accused sustained a considerable long injury inflicted by a<\/p>\n
chopper and the allegations made by the accused is more<\/p>\n
probable, it is submitted. The defacto complainant is the<\/p>\n
aggressor and hence, petitioner may be granted anticipatory<\/p>\n
bail, it is submitted.   It is also submitted that the defacto<\/p>\n
complainant had enmity towards petitioners, who are brothers,<\/p>\n
since the defaco complainant’s brother was abused by the first<\/p>\n
accused.     It was as a retaliation that he had attacked the<\/p>\n
petitioners in the manner alleged in crime no.206\/08, it is<\/p>\n
submitted.\n<\/p>\n

      5.    This petition is opposed. Learned public prosecutor<\/p>\n
submitted that the allegations made in this case are serious in<\/p>\n
nature. A1 and A2 both used knives and the defacto complainant<\/p>\n
was injured also.      There were five persons on the side of<\/p>\n
petitioners and it is not a fit case to grant anticipatory bail<\/p>\n
especially since the knives are to be recovered.            Only if<\/p>\n
petitioners are interrogated, the recovery of weapon can be<\/p>\n
effected, it is submitted.  It is also submitted by learned public<\/p>\n
prosecutor that the accused could not be taken into custody by<\/p>\n
the police after the arrest of the first accused from his house. He<\/p>\n
was rescued and in connection with the said incident, crime<\/p>\n
no.208\/08 was registered.\n<\/p>\n
      6.    On hearing both sides and on an evaluation of the<\/p>\n
facts and circumstances of the case and documents produced<\/p>\n
relating to the injury sustained, I am satisfied that petitioners<\/p>\n
can be granted anticipatory bail. Petitioners are prepared to<\/p>\n
abide by any condition and co-operate with investigation.<\/p>\n
Therefore, the following order is passed:\n<\/p>\n
             Petitioners shall surrender before the Magistrate<\/p>\n
             Court concerned and they shall be released on bail<\/p>\n

             on their executing bond for Rs.25,000\/- each with two<\/p>\n
             solvent sureties each for like sum to the satisfaction<\/p>\n
             of  the    learned  Magistrate    on    the  following<\/p>\n
             conditions :\n<\/p><\/blockquote>\n
            (i)   Petitioners shall report before the Investigating<\/p>\n
                  Officer on every Sunday between 10 a.m. to 1<\/p>\n
                  p.m., within two days of their release on bail and<\/p>\n
                  co-operate    with   investigation   and    make<\/p>\n
                  themselves available for interrogation.<\/p>\n<\/blockquote>\n
             (ii) Petitioners shall not influence or intimidate any<\/p>\n
                  witness or commit any offence while on bail.<\/p>\n
    The petition is allowed.<\/p><\/blockquote>\n
