Justice P.N.RAVINDRAN\n\n Dated :15\/11\/2010\n\n O R D E R\n                        P.N.RAVINDRAN, J.\n               -----------------------------------------\n                    W.P(C).No.31435 of 2010\n               -----------------------------------------\n          Dated this the 15th day of November, 2010\n\n                             JUDGMENT\n<\/pre>\n<p>      The petitioners and respondents 2 and 3 are neighbours.<\/p>\n<p>When the second respondent commenced construction of a<\/p>\n<p>residential building, the petitioners filed a representation before<\/p>\n<p>the Secretary of the first respondent Grama Panchayat alleging<\/p>\n<p>that the construction is in violation of the Kerala Municipality<\/p>\n<p>Building Rules, 1999.      On receipt of the said complaint, the<\/p>\n<p>Secretary of the first respondent Grama Panchayat conducted a<\/p>\n<p>local inspection and thereafter issued Ext.P1 memo dated<\/p>\n<p>6.9.2010 calling upon the second respondent to forthwith stop the<\/p>\n<p>construction. It appears respondents 2 and 3 did not comply with<\/p>\n<p>the said order. The petitioners thereupon instituted O.S.No.385 of<\/p>\n<p>2010 in the Court of the Munsiff of Muvattupuzha. In that suit,<\/p>\n<p>they filed I.A.No.2521 of 2010 for an interim order of injunction in<\/p>\n<p>terms of the relief of injunction prayed for in the plaint. On that<\/p>\n<p>application the court below passed Ext.P2 order of injunction<\/p>\n<p>restraining the second respondent herein from putting up any<\/p>\n<p>W.P(C).No.31435 of 2010<br \/>\n<span class=\"hidden_text\">                                     -:2:-<\/span><\/p>\n<p>construction in violation of the building rules until further orders.<\/p>\n<p>It is thereafter that this writ petition is filed seeking the following<\/p>\n<p>reliefs:-\n<\/p>\n<blockquote><p>      i)       issue a writ of mandamus or appropriate writ,<\/p>\n<p>               order or direction to the 1st respondent to take<\/p>\n<p>               necessary steps to stop the illegal construction<\/p>\n<p>               made by the 2nd and 3rd respondents       in the<\/p>\n<p>               property of the 2nd respondent.\n<\/p><\/blockquote>\n<blockquote><p>      ii)      issue a writ of mandamus or appropriate writ<\/p>\n<p>               order to the 1st respondent to immediately<\/p>\n<p>               demolish the building constructed by the<\/p>\n<p>               respondent No.2 in his property as it is in<\/p>\n<p>               violation of the Kerala Panchayat Raj Act 1994<\/p>\n<p>               and Building Rules.<\/p><\/blockquote>\n<p>       2.  Shorn of details, the main relief sought in the writ<\/p>\n<p>petition is to direct the first respondent Grama Panchayat to stop<\/p>\n<p>the construction made by respondents 2 and 3 and to demolish<\/p>\n<p>the building put up by them. The pleadings disclose that seeking<\/p>\n<p>the very same reliefs the petitioner has already instituted<\/p>\n<p>O.S.No.385 of 2010 in the Court of the Munsiff of Muvattupuzha<\/p>\n<p>and in that suit an ad interim order of injunction has been passed.<\/p>\n<p>An Advocate Commissioner was also appointed in that suit and<\/p>\n<p>that the Commissioner has filed a report and sketch. A Full Bench<\/p>\n<p>of this Court has in Reena v. Geena, 2010 (2) KLT 155 (FB),<\/p>\n<p>W.P(C).No.31435 of 2010<br \/>\n<span class=\"hidden_text\">                                    -:3:-<\/span><\/p>\n<p>held that a litigant should not be allowed to prosecute parallel<\/p>\n<p>remedies, one in this Court under Article 226 of the Constitution<\/p>\n<p>of India and the other in the civil court by way of a suit.
