No.43906 of 2010\n                      PANKAJ BAITHA, SON OF SYAM BILASH BAITHA\n                                            Versus\n                                  THE STATE OF BIHAR\n                                          -----------\n<\/pre>\n<p>02    19.01.2011               Heard learned counsel for the petitioner as well<\/p>\n<p>                    as learned P.P. for the State.\n<\/p>\n<p>                                  Petitioner seeks his bail in connection with<\/p>\n<p>                    Durgawati P.S. Case No 37 of 2010 registered under Sections<\/p>\n<p>                    386\/34 of the Indian Penal Code.\n<\/p>\n<p>                                  At the very outset, learned counsel for the<\/p>\n<p>                    petitioner submits that having more or less similar allegation,<\/p>\n<p>                    co-accused Nagendra Yadav and others have already been<\/p>\n<p>                    granted privilege of bail.\n<\/p>\n<p>                                  Although, learned Public Prosecutor opposed the<\/p>\n<p>                    prayer on the ground that petitioner carries criminal antecedent<\/p>\n<p>                    but considering the aforesaid facts and circumstances of the<\/p>\n<p>                    case as well as period of detention of the petitioner in jail<\/p>\n<p>                    custody above named petitioner is directed to be released on<\/p>\n<p>                    bail on furnishing bail bonds of Rs. 10,000\/- (Ten Thousand)<\/p>\n<p>                    with two sureties of the like amount each to the satisfaction of<\/p>\n<p>                    Chief Judicial Magistrate, Kaimur at Bhabua in connection<\/p>\n<p>                    with above stated Durgawati P.S.
