Upadhyay,APP\n                                       -----------\n<\/pre>\n<p>02.   28.10.2010               Heard counsel for the petitioner.<\/p>\n<p>                               While assailing the order dated 06.02.2009, passed<\/p>\n<p>                   by learned CJM, Madhubani in G.R.No.1962\/03, whereby<\/p>\n<p>                   cognizance under sections 302 and 498A IPC has been taken<\/p>\n<p>                   finding prima facie case against the petitioner, it is submitted<\/p>\n<p>                   that there is no legal material against him. It is contended that<\/p>\n<p>                   the victim died a natural death.\n<\/p>\n<p>                               It appears that petitioner has not enclosed even the<\/p>\n<p>                   copy of the     FIR.    He refers to certain statement of the<\/p>\n<p>                   informant\/complainant made under section 164 Cr. P.C. which<\/p>\n<p>                   has also not been enclosed.\n<\/p>\n<p>                               Considering    the     confines   of   the   jurisdiction<\/p>\n<p>                   exercised by learned CJM and also the contents of the order<\/p>\n<p>                   impugned, this Court is not inclined to interfere therewith. The<\/p>\n<p>                   application is accordingly dismissed.<\/p>\n<p>                                           ( Kishore K.
