The said application is rejected by the trial<\/p>\n<p>cO*O.rt&#8217;IOn  that the application is filed after expiry Of<\/p>\n<p>C90 days the date of Service of notice and that as per Order<\/p>\n<p>it Rule N1, written Statement should have been \ufb01led within 90<\/p>\n<p>&#8216;   from the date of service Of summons. E <\/p>\n<p>WP No.-4045\/2008<\/p>\n<p>2. Learned counsel for the petitioner submits that, the<br \/>\nsummons was not served on the petitioner. He was<br \/>\nthe village for earning his livelihood and during<br \/>\nserved on the family members of thempetitiorie1~.\u00bb&#8211;i.:it  it<br \/>\nreason, he did not appear before the copuritiarrd<br \/>\nexparte. Thereafter he filed IA&#8211;&#8216;I\\[_. forts:-\ufb01tting<br \/>\norder and the said application al.loWed;-  allowing<br \/>\nthe said application,  permitted to<br \/>\nfile written statement.   allowed IA&#8211;IV<br \/>\nholding that   suf\ufb01cient cause for not<br \/>\nappearing   \ufb01xed for first hearing<br \/>\nand  order  petitioner exparte. The trial court is directed to<\/p>\n<p> permit the petitioner to tile written statement.
