The petitioners have challenged<br \/>\nthe decision of the Election Officer dated 22.2.2010 whereby<br \/>\nobjections submitted by the petitioners to the voters list prepared<br \/>\nby the Election Officer have been rejected. It is the contention of<br \/>\nthe petitioners that just objections raised by them have been<br \/>\narbitrarily rejected by the Election Officer on technical grounds<br \/>\nwithout considering the merits of those objections.\n<\/p>\n<p>\tIt<br \/>\nis not in dispute that the objections have been rejected by an order<br \/>\ndated 22.2.2010 and that the Election Officer has published the final<br \/>\nvoters list on 25.2.2010 for conducting the election of The Jamnagar<br \/>\nDistrict Cooperative Bank. It is pertinent to note that this Court in<br \/>\na cognate matter wherein inaction of the Election Officer in<br \/>\nproceeding further with the election process after having published<br \/>\nthe final voters list had issued notice whereupon a statement has<br \/>\nbeen made by the learned Government advocate on the instructions of<br \/>\nthe Election Officer that the election programme would be published<br \/>\nimmediately. It is likely that the election programme would have been<br \/>\npublished by the Election Officer by now.\n<\/p>\n<p>\tLearned<br \/>\nadvocate, Mr.Rana, appearing for the petitioners has not been able to<br \/>\nexplain the reasons for the delay in filing the petition challenging<br \/>\nthe rejection order dated 22.2.2010. It is only when a statement is<br \/>\nmade on behalf of the Election Officer that he would proceed to<br \/>\npublish the election programme that the present petition has been<br \/>\nfiled. This creates suspicion of the petition being a sponsored one<br \/>\nand aimed at delaying the election process in any manner whatsoever.\n<\/p>\n<p>\tIn<br \/>\nview of the above, we are of the opinion that the petition deserves<br \/>\nto be dismissed on the ground that it has been filed belatedly and<br \/>\nperhaps with an intention of delaying the election process.
