                           J U D G M E N T<\/p>\n
            Petitioner challenges Ext.P5.             Ext.P5 is an order<\/p>\n
granting permission to draw line for giving connection to the 3rd<\/p>\n
respondent.\n<\/p>\n
      2.    I heard learned counsel for the petitioner, learned<\/p>\n
standing counsel for the Board, learned counsel for the 3rd<\/p>\n
respondent and learned Government Pleader. Learned counsel<\/p>\n
for petitioner would contend that Ext.P1 commission report would<\/p>\n
show that the proposed line is unsuitable. The extent of land is 13<\/p>\n
cents and alternate routes are there, it is contended.<\/p>\n
      3.    Per contra, it is submitted on behalf of the respondents<\/p>\n
that the alternate routes suggested by the petitioner cannot be<\/p>\n
accepted. The first alternate route has to pass over the properties<\/p>\n
of four persons which are shown as No.4, 5, 6 and 7. Its length<\/p>\n
would be 86 meters of Over Head line and 17 meters of Weather<\/p>\n
Proof line. As far as the second alternate route is concerned, the<\/p>\n
properties of two persons will have to be crossed, namely 9 and<\/p>\n
10 in Ext.R2(a). The length will be 128 meters of over head line<\/p>\n

and for this posts will have to be made. As far as the proposed<\/p>\n
line ABC is concerned, the property crossing will be limited to one<\/p>\n
only, namely the petitioner.\n<\/p>\n
      4.   I put a query to the counsel whether the line can be<\/p>\n
drawn in such a manner that it passes along the boundary of the<\/p>\n
property of the petitioner. Learned standing counsel would submit<\/p>\n
that if two posts are erected, the line can be drawn along the<\/p>\n
boundary of the property of the petitioner to the extent possible.<\/p>\n
Learned counsel for the 3rd respondent is agreeable to bear the<\/p>\n
additional expenses for putting of two posts.              In such<\/p>\n
circumstances, Ext.P5 is modified to the extent only that the line is<\/p>\n
permitted to be drawn through the property of the petitioner but<\/p>\n
subject to the modification that it will be drawn in such a manner<\/p>\n
that it progresses along the boundaries of the property of the<\/p>\n
petitioner as far as possible and with the aid of two additional<\/p>\n
posts the expense of which would be met by the 3rd respondent.<\/p>\n
      Writ petition is disposed of as above.\n<\/p>\n<\/p>\n
