Dave, learned advocate appearing on behalf of the petitioner<br \/>\n\tseeks permission to withdraw this petition with a liberty to move an<br \/>\n\tappropriate application before Motor Accident Claims Tribunal,<br \/>\n\tBhavnagar for restoration of Motor Accident Claims Petition No.1041<br \/>\n\tof 2000 which was disposed of by the learned District Judge, Motor<br \/>\n\tAccident Claims Tribunal (Main), Bhavnagar on 14th June,<br \/>\n\t2006 by exercising power under Order   7, Rule 11(C) of the Civil<br \/>\n\tProcedure Code as the petitioner has not paid the Court Fees.<br \/>\n\tPermission as prayed for is granted.\n<\/p>\n<p>Mr.Dave<br \/>\n\thas submitted that the petitioner has no knowledge about the payment<br \/>\n\tof the Court Fees. He has further submitted that the petitioner was<br \/>\n\tneither given an opportunity of hearing nor was served with the<br \/>\n\tnotice of non-payment of the Court Fees. Though the petitioner has<br \/>\n\tmade applications on 30th March, 2009 and 1st<br \/>\n\tSeptember, 2009, no order is passed on the said applications.\n<\/p>\n<p>It<br \/>\n\tappears that the said applications are not in accordance with the<br \/>\n\tprovisions of the Civil Procedure Code. If the petitioner wants to<br \/>\n\tget the Motor Accident Claims Petition restored, he has to move the<br \/>\n\tappropriate application along with the application for condonation<br \/>\n\tof delay and on considering the facts of the case, the trial Court<br \/>\n\thas to condone the delay and take up the main petition. Since this<br \/>\n\tprocedure is not taken by the petitioner, the petitioner is hereby<br \/>\n\tpermitted to withdraw this petition with a liberty to move such<br \/>\n\tapplication for restoration along with the application for<br \/>\n\tcondonation of delay and, thereafter, the Motor Accident Claims<br \/>\n\tTribunal shall hear and decide such application on payment of Court<br \/>\n\tFees, in accordance with law and on merits after considering the<br \/>\n\taverments that may be made by the petitioner in such application.\n<\/p>\n<p>With<br \/>\n\tthese observations, the present petition is, accordingly disposed of<br \/>\n\tas withdrawn.\n<\/p>\n<p>[<br \/>\nK.
