COUNSEL with  MR\nPARESH M DARJI for\nAppellant(s) : 1, \nMR ASPI KAPADIA MR DEVANG J JOSHI for\nRespondent(s) : 1, \nNone for Respondent(s) : 2, 2.2.1,2.2.2 - 9,\n9.2.1, 9.2.2,9.2.3 -\n13. \n=========================================================\n\n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE KS JHAVERI\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 22\/03\/2011 \n\n \n\n \n \n ORDER\n<\/pre>\n<p>IN APPEAL FROM ORDER<\/p>\n<p>\t\tAdmit.\n<\/p>\n<p>\t\t\t\t\t\t\t(K.S.JHAVERI,<br \/>\nJ.)<\/p>\n<p> ORDER<br \/>\nIN CIVIL APPLICATION <\/p>\n<p>\tHeard<br \/>\nMr. Mihir Joshi, Senior Counsel for the applicant and Mr.  \tAspi<br \/>\nKapadia, learned advocate for the respondent no.1.\n<\/p>\n<p>\tWhen<br \/>\nthis Court was inclined to grant interim relief, Mr. Kapadia<br \/>\n\trequested for adjournment which is declined.\n<\/p>\n<p>\tBy<br \/>\nthe impugned order dated 22.02.2011, this Court ordered \tstatus quo<br \/>\nand restrained the applicant from selling or transferring \tthe<br \/>\nproperty in question and it was further ordered that the<br \/>\n\tplaintiff-respondent  may, at his own costs, after giving notice<br \/>\n\tprepare a panchnama and thereafter the parties shall maintain<br \/>\n\tstatus quo as per the Panchana.\n<\/p>\n<p>\tFrom<br \/>\nthe record, prima facie it appears that  the agreement which \twas<br \/>\nsought to be executed was dated 06.03.1995 which is 15\tyears prior to<br \/>\nthe filing of the suit. It also appears that the name of\tthe<br \/>\nappellant\/applicant was mutated in the revenue record which \tis<br \/>\n\tproduced on record. The trial court has ordered  for a \tPanchnama of<br \/>\nthe property which was prepared on 08.03.2011. I<\/p>\n<p>\tIn<br \/>\nthe Panchnama, it is stated that there are two boards found on \tthe<br \/>\npremises. One Board states that  Mr. Chetan Krishnakant \tShah is the<br \/>\nowner of the said Survey No.128\/6 and the \ttrespassers will be<br \/>\nprosecuted. The second board states that  the \tproperty bearing<br \/>\nSurvey No.128\/6 situated at village Sanand, \tDistrict Ahmedabad is of<br \/>\ntheir ownership since 18.10.1995 and that \tthe Civil Court has passed<br \/>\nan order in Special Civil Suit \tNo.183\/2010 to maintain \tstatus quo<br \/>\nof the said land. A copy of the \tpanchnama is produced on record of<br \/>\nthis case. It is pointed out \tthat no notice was issued to the<br \/>\napplicant regarding the \tpanchnama of the suit premises and there is<br \/>\nno application for \tpreparing the Panchnama of the land in question<br \/>\nby any party. \tLearned Advocate for the respondent submitted that<br \/>\nthe\tCourt has power \tto issue directions for preparing panchnama by<br \/>\n\trelying upon\tprovisions of Order XXVI of CPC. However, in the<br \/>\n\tpresent case, the fact remains that no notice has been issued to<br \/>\n\tthe present \tpetitioner for such purposes.\n<\/p>\n<p>\tBut<br \/>\nthe fact remains that the respondent has taken undue\tadvantage of the<br \/>\ninterim injunction by placing a Board stating that\tthere is<br \/>\ninjunction order in his favour and that he is the holder of\tthe<br \/>\nproperty. After granting the injunction order panchnama was\tordered<br \/>\nto be prepared. The resultant effect is that the\trespondent-plaintiff<br \/>\non his own, without issuing notice to the\tpetitioner, got the<br \/>\npanchnama prepared and the order of the court \tis that such status<br \/>\nquo is required to be maintained. Therefore\tprima facie the order of<br \/>\nthe trial court becomes perverse.\n<\/p>\n<p>\tIn<br \/>\nview of the above the following order is passed:\n<\/p>\n<p>\tRule<br \/>\nreturnable on 4th April 2011. The impugned  order<br \/>\ndated\t22.02.2011 passed below Exh.5 in Civil Suit No.183 of 2010 by<br \/>\nthe\tlearned 3rd Additional Senior Civil Judge, Ahmedabad<br \/>\n(Rural) is\tstayed till next date. The appellant\/applicant shall not<br \/>\ntransfer the \tproperty in question pending the appeal.\n<\/p>\n<p>\tAt<br \/>\nthis stage Mr. Kapadia, learned Advocate for the respondent \thas<br \/>\nrequested for stay of the present order.
