Justice THOTTATHIL B.RADHAKRISHNAN\n\n Dated :19\/10\/2009\n\n O R D E R\n            THOTTATHIL B.RADHAKRISHNAN, J.\n                  -------------------------------------------\n                    W.P(C).No.9910 OF 2009\n                  -------------------------------------------\n             Dated this the 19th day of October, 2009\n\n\n                              JUDGMENT\n<\/pre>\n<p>      The petitioner alleges that the 4th respondent is carrying on<\/p>\n<p>certain activity of construction of septic tank etc. in a manner<\/p>\n<p>depriving the petitioner and her daughter of peaceful living.<\/p>\n<p>The third respondent Revenue Divisional Officer has taken a<\/p>\n<p>view that proceedings under Section 133 Cr.P.C. is not<\/p>\n<p>warranted. The second respondent grama panchayat, through<\/p>\n<p>counsel, states that discussions were held for a negotiated<\/p>\n<p>settlement, on the basis of Ext.P4, however, that there is no<\/p>\n<p>reason to issue any direction as sought for by the petitioner,<\/p>\n<p>since, according to the grama panchayat, no reason could be<\/p>\n<p>attributed to the 4th respondent as alleged.<\/p>\n<p>      With the aforesaid, all that is required at this point of time<\/p>\n<p>is for the competent authority in the second respondent to issue<\/p>\n<p>appropriate orders in terms of the statutory provisions, so that<\/p>\n<p>WPC.9910\/09<\/p>\n<p>                            Page numbers<\/p>\n<p>the petitioner, if aggrieved, could take that matter to the further<\/p>\n<p>statutory authorities in accordance with law and seek redressal.<\/p>\n<p>Let such orders be issued within a period of four weeks from the<\/p>\n<p>date of receipt of a copy of this judgment. All issues on merits<\/p>\n<p>are left open.
