The husband\/ respondent herein filed his<br \/>\n\tappearance through learned advocate Shri.Suresh S. Patel. Shri Patel<br \/>\n\t submitted that there were chances for bringing about settlement<br \/>\n\twith husband wife so as to put an end to the entire controversy,<br \/>\n\thence time was requested, which was granted. The matter was<br \/>\n\tadjourned at this request. Ultimately, as per the submission of<br \/>\n\tlearned advocate for the petitioner, the settlement was not possible<br \/>\n\tand she made request for hearing the matter finally. After advocates<br \/>\n\tjoint request for deciding the matter finally same was taken up for<br \/>\n\thearing. Hence Rule. Rule is fixed forthwith at the request of<br \/>\n\tlearned advocates for the parties.\n<\/p>\n<p>The<br \/>\n\tpetitioner, as it is stated herein above, opponent of HMP No. 1762<br \/>\n\tof 2010, had to file this petition as she is residing at Ahmedabad<br \/>\n\twith her 2 years old son. The petitioner is given shelter by her<br \/>\n\tmother who is serving in Ahmedabad. Petitioner&#8217;s father is residing<br \/>\n\tat Bharuch on account of his being employed at Bharuch. Thus the<br \/>\n\tpetitioner is to fend for herself and  her son along with her mother<br \/>\n\tat Ahmedabad. The petitioner has also preferred proceedings for<br \/>\n\tseeking maintenance  under section 125 of Criminal Procedure Code.<br \/>\n\tPetitioner has pleaded that if she is compelled to visit Vadodara in<br \/>\n\tconnection with H.M. Petition No. 1762 of 2010, untold hardships<br \/>\n\twould be faced by her and in view of these hardships, she would not<br \/>\n\tbe in a proper position to defend the case against her.\n<\/p>\n<p>Learned<br \/>\n\tadvocate Shri Patel appearing for respondent husband submitted that<br \/>\n\tthe transfer petition is premature as the H.M. Petition is at the<br \/>\n\tstage of filing of reply. Without any tangible threat of any nature<br \/>\n\twife has preferred this petition. When the wife has not attended the<br \/>\n\tCourt proceeding at Vadodara there ought not to have been any<br \/>\n\tquestion of she facing any threats which have been narrated in the<br \/>\n\tpetiton. The apprehension of wife in respect of her child being<br \/>\n\tsnatched away at Vadodara has no justification whatsoever and<br \/>\n\ttherefore, on such apprehension this Court may not transfer the<br \/>\n\tpetition. Shri Patel has invited this Court&#8217;s attention to the<br \/>\n\taverments made in the affidavit-in-reply filed on behalf of the<br \/>\n\thusband mentioning that the husband is ready &amp; willing to pay<br \/>\n\tthe travelling expenses to the wife so that she may attend the Court<br \/>\n\tproceediings at Vadodara.   The inconvenience caused to wife for<br \/>\n\tattending the proceedings alone cannot be a ground for ordering<br \/>\n\ttransfer under section 24 of Civil Procedure Code. In view of these,<br \/>\n\tthe transfer petition is strongly resisted.\n<\/p>\n<p>This<br \/>\n\tCourt is unable to accept submissions of Shri Patel, learned<br \/>\n\tadvocate appearing for the respondent husband for the following<br \/>\n\treasons.\n<\/p>\n<p>The<br \/>\n\twife has stated    on oath before this Court that she has no other<br \/>\n\tmeans of livelihood and she has to fend for herself as well as her<br \/>\n\tson at her mother&#8217;s place. The mother being a serving member, if the<br \/>\n\twife is compelled to attend the Court at Vadodara, will have to be<br \/>\n\tleft alone her 2 year old chiled, as there is no one to look after<br \/>\n\tthe child.\n<\/p>\n<p>The<br \/>\n\tchild in fact was requested to be given in adoption to the<br \/>\n\tsister-in-law, who is unmarried and all these circumstances has<br \/>\n\tdissuade the wife from undergoing travel alone from Ahmedabad to any<br \/>\n\tother place.\n<\/p>\n<p>\tThe<br \/>\n\tinconvenience caused to the wife would render adverse effect upon<br \/>\n\ther ability to defend the proceedings at Vadodara.\n<\/p>\n<p>It<br \/>\n\tis also required to be noted that wife has already moved proceedings<br \/>\n\tbefore the competent Court at Ahmedabad for obtaining maintenance<br \/>\n\tfor herself and her son from the husband.\n<\/p>\n<p>\tIn<br \/>\n\tview of totality of the facts &amp; circumstances of the case, the<br \/>\n\tsubmission made by learned advocate for the respondent husband<br \/>\n\tcannot be accepted that the present application is premature as the<br \/>\n\twife has not faced any difficulties so far, and, therefore, the<br \/>\n\tpetition cannot be entertained.\n<\/p>\n<p>In<br \/>\n\tfact it should be the endeavour of both the parties to see that both<br \/>\n\tthe parties may get fair trial and when peculiar facts &amp;<br \/>\n\tcircumstances facing various difficulties are pleaded which would<br \/>\n\tcreep into ability of the wife to defend the petition at Vadodara,<br \/>\n\tthis Court is of the view that it would be in the interest of<br \/>\n\tjustice that the H.M. Petition No. 1762 of 2010 preferred by the<br \/>\n\trespondent husband before he Family Court at Vadodara is transferred<br \/>\n\tto concerned Family Court at Ahmedabad.\n<\/p>\n<p>In<br \/>\n\tview of above, present application is allowed. It is ordered that<br \/>\n\tH.M. Petition No. 1762 of 2010 preferred by the respondent herein \/<br \/>\n\thusband before the Family Court at Vadodara is transferred to<br \/>\n\tconcerned Family Court at Ahmedabad.  The Family Court at Ahmedabad,<br \/>\n\tafter receiving H.M. Petition No. 1762 of 2010 from Family Court,<br \/>\n\tVadodara, shall give fresh number and thereafter to issue notice to<br \/>\n\tthe parties.\n<\/p>\n<p>Application<br \/>\n\tis disposed of.
