Heard learned counsel for the<\/p>\n<p>                   petitioner and the State.\n<\/p>\n<p>                            2. Petitioner was an applicant for<\/p>\n<p>                   appointment    on    the    post      of    Constable<\/p>\n<p>                   pursuant to Advertisement No. 1\/98 under the<\/p>\n<p>                   Home Guard Category but was not selected.<\/p>\n<p>                   He approached the High Court in C.W.J.C. No.<\/p>\n<p>                   4819 of 2001 which was disposed of under<\/p>\n<p>                   orders dated 22.11.2004 directing the Deputy<\/p>\n<p>                   Inspector General, Central Range, Patna to<\/p>\n<p>                   consider the grievance of the petitioner and to<\/p>\n<p>                   pass a reasoned order. In compliance of the<\/p>\n<p>                   said order D.I.G., Central Range, Patna passed<\/p>\n<p>                   order   bearing     Memo       No.         153     dated<\/p>\n<p>                   12.02.2007,       Annexure-2         rejecting       the<\/p>\n<p>                   representation of the petitioner holding that<\/p>\n<p>                   candidature    of   the     petitioner       was     not<\/p>\n<p>                   considered for appointment under the Home<\/p>\n<p>                   Guard Category as petitioner acquired training<\/p>\n<p>                   as Home Guard from State of U.P. and under<br \/>\n<span class=\"hidden_text\">                                      2<\/span><\/p>\n<p>         Advertisement         No.       1\/98        there   was       clear<\/p>\n<p>         stipulation        that   Home          Guards       acquiring<\/p>\n<p>         training from other States than Bihar shall not<\/p>\n<p>         be considered.\n<\/p>\n<p>                     3.     Counsel            for     the    petitioner<\/p>\n<p>         submitted that aforesaid stipulation confining<\/p>\n<p>         the selection of Home Guards from amongst<\/p>\n<p>         the Home Guards of Bihar is discriminatory<\/p>\n<p>         and violative of Article 14 of the Constitution<\/p>\n<p>         of India.\n<\/p>\n<p>                     4. Without going into the correctness<\/p>\n<p>         or otherwise of the aforesaid submission it is<\/p>\n<p>         observed         that before          participating      in the<\/p>\n<p>         selection process pursuant to Advertisement<\/p>\n<p>         No. 1\/98 which debarred the Home Guards of<\/p>\n<p>         other States from participating in the selection<\/p>\n<p>         test petitioner should have challenged such<\/p>\n<p>         clause      as    violative      of    Article      14   of    the<\/p>\n<p>         Constitution of India. Petitioner having not<\/p>\n<p>         challenged the clause of advertisement, in my<\/p>\n<p>         opinion, is not justified in submitting that his<\/p>\n<p>         candidature be considered in the category of<\/p>\n<p>         Home Guard.\n<\/p>\n<p>                     5. There is no merit in the writ<\/p>\n<p>         petition, which is, dismissed.<\/p>\n<pre>P.K.P.
