SHAH\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 12\/12\/2006 \n\n \n\n \n \nCOMMON\nORAL JUDGMENT<\/pre>\n<p>Both<br \/>\n\tthese Company Petitions are filed by the respective petitioners for<br \/>\n\tan appropriate order of winding up of the respondent company i.e.<br \/>\n\tM\/s. Payal Polyurethane Private Ltd under the provisions of the<br \/>\n\tCompanies Act; 1956.\n<\/p>\n<p>Today,<br \/>\n\twhen the matters are called out, Shri G.K.Mehta, learned advocate<br \/>\n\tappearing for Shri N.K.Majmudar, learned advocate appearing for the<br \/>\n\trespondent company has submitted Undertakings in each of the Company<br \/>\n\tPetitions by submitting that so far as the petitioner of Company<br \/>\n\tPetition No. 25 of 2004 is concerned, outstanding amount (principal<br \/>\n\tamount) of Rs. 3 Lacs would be paid to the petitioner by Demand<br \/>\n\tDraft towards the full and final settlement of the outstanding dues<br \/>\n\ton or before 27th December, 2006. Similarly, an<br \/>\n\tUndertaking is filed in Company Petition No. 27 of 2004 on behalf of<br \/>\n\tthe respondent company affirmed by one Shailesh M. shah, Director of<br \/>\n\tthe respondent company that the outstanding amount (principal<br \/>\n\tamount) of Rs.10 Lacs would be paid to the petitioner of Company<br \/>\n\tPetition No. 27 of 2004 by Demand Draft towards full and final<br \/>\n\tsettlement of the outstanding dues on or before 27th<br \/>\n\tDecember, 2006. Both the Undertakings are directed to be taken on<br \/>\n\trecord. The aforesaid Demand Drafts be paid directly either to the<br \/>\n\trespective petitioners and\/or their learned advocates. The<br \/>\n\trespondent Company is directed to act accordingly.\n<\/p>\n<p>In<br \/>\n\tview of the above, no further order is required to be passed by this<br \/>\n\tCourt. However, liberty is reserved to revive the present Company<br \/>\n\tPetitions in case of difficulty. Both these Company Petitions are<br \/>\n\taccordingly disposed of.
