SHAH\n\t\t\n\t\n\n \n\nDate\n: 23\/11\/2010 \n\n \n\nORAL\nORDER<\/pre>\n<p>1.\t\tRule.\n<\/p>\n<p>Mr.Dagli, learned advocate waives service of notice of Rule on behalf<br \/>\nof the respondents- original accused.\n<\/p>\n<p>2.\t\tIn<br \/>\nthe facts and circumstances of the case and with the consent of the<br \/>\nlearned advocates appearing on behalf of the respective parties, the<br \/>\npresent Criminal Revision Application is taken up for final hearing<br \/>\ntoday.\n<\/p>\n<p>3.\t\tThe<br \/>\npresent Criminal Revision Application under Section 397 read with<br \/>\nSection 401 of the Code of Criminal Procedure has been preferred by<br \/>\nthe applicant &#8211; State of Gujarat to quash and set aside the<br \/>\norder dated 12\/04\/2010 passed by the Trial Court, by which, the<br \/>\nlearned Trial Court has not granted permission exhibiting the<br \/>\ndocuments produced at Mark 47\/1 i.e. statement of one Pravin Popatlal<br \/>\nrecorded by Royalty Inspector, Porbandar during his inquiry and<br \/>\nperforming his duty on 28\/12\/2006; Royalty receipt\/royalty book;<br \/>\npanchnama prepared by Royalty Inspector and other documents.\n<\/p>\n<p>4.\t\tHaving<br \/>\nheard the learned advocates appearing on behalf of the respective<br \/>\nparties and considering the impugned judgement and order dated<br \/>\n12\/04\/2010 passed by learned Sessions Judge, Porbandar, it appears<br \/>\nthat the learned Sessions Court has committed an error and\/or<br \/>\nillegality in not exhibiting the documents produced at Mark 47\/1,<br \/>\nwhich are produced during the course of recording of evidence of<br \/>\nAndegneshwar Shivnarayan Rav, Royalty Inspector &#8211; P.W.29,<br \/>\nexamined at Exh-48. Considering the documents which were sought to be<br \/>\nexecuted, it appears that those documents are relevant to prove the<br \/>\ncase of the prosecution. If the accused are disputing the said<br \/>\ndocuments, an ample opportunity shall be given to the accused to<br \/>\ncross-examine the said witnesses with respect to those documents,<br \/>\nwhich are sought to be executed. However by not exhibiting the<br \/>\ndocuments produced at Mark 47\/1, the prosecution case is prejudiced.\n<\/p>\n<p>5.\t\tIn<br \/>\nview of the above, Mr.Mahesh Pujara, learned advocate appearing for<br \/>\nMr.Ashish Dagli, learned advocate appearing on behalf of the<br \/>\nrespondents &#8211; original accused, has submitted that in that case<br \/>\nif this Court is of the opinion that learned Sessions Court ought to<br \/>\nhave given exhibit number to the documents produced at Mark-47\/1, in<br \/>\nthat case, the respondents herein-accused shall be given an<br \/>\nopportunity to cross-examine the concerned witnesses with respect to<br \/>\nthe said documents. The aforesaid request seems to be reasonable.\n<\/p>\n<p>6.\t\tIn<br \/>\nview of the above and for the reasons stated hereinabove and stand<br \/>\ntaken by Mr.Mahesh Pujara, learned advocate appearing on behalf of<br \/>\nthe  respondents &#8211; original accused, the impugned order dated<br \/>\n12\/04\/2010 passed by Sessions Court, Porbandar in not exhibiting the<br \/>\ndocuments produced at Mark-47\/1 is hereby quashed and the Trial Court<br \/>\nis hereby directed to give exhibit number to the documents, which are<br \/>\nproduced at Mark-47\/1 subject to right of the original accused to<br \/>\ncross-examine the  concerned  witnesses with respect to the said<br \/>\ndocuments. It will always open for the respondents &#8211; original accused<br \/>\nto cross-examine the concerned witnesses on the said documents and<br \/>\ncertainly the said right shall be given to the original accused by<br \/>\nthe concerned Judge.
