Whether the judgment should be reported in the Digest?\n\n\n\nPRESENT:            Mr.Vikas Mehsempuri, Advocate,\n                    for the petitioner.\n\n                                  ****\n\nRANJIT SINGH, J.\n<\/pre>\n<p>             The petitioner filed an application under Section 311<\/p>\n<p>Cr.P.C. for grant of permission to lead additional evidence, which has<\/p>\n<p>been declined. The petitioner in fact wanted to tender the following<\/p>\n<p>pieces of evidence:-\n<\/p>\n<blockquote><p>             i) Certified copy of report under Section 173 Cr.P.C. in<\/p>\n<p>                case FIR No.31 dated 1.1.2006 U\/s 420 IPC, P.S.<br \/>\n<span class=\"hidden_text\"> Criminal Revision No.2144 of 2008 (O&amp;M)              :2:<\/span><\/p>\n<p>             Kotwali, Barnala.\n<\/p><\/blockquote>\n<blockquote><p>          ii) Certified copy of Enquiry report dated 11.1.2006.<\/p>\n<\/blockquote>\n<blockquote><p>          iii) Complaint dated nil moved by Vijay Kumar against<\/p>\n<p>             Beant Singh complainant.\n<\/p><\/blockquote>\n<blockquote><p>          iv)   Statements   under   Section   161    Cr.P.C.     Dated<\/p>\n<p>             10.12.2005.\n<\/p><\/blockquote>\n<blockquote><p>          v) Statement of accused Vijay Kumar U\/s 161 Cr.P.C.<\/p>\n<p>             dated 5.2.2006 of accused Vijay Kumar.<\/p><\/blockquote>\n<p>          The petitioner is facing prosecution under Sections 3 and<\/p>\n<p>4 of the Scheduled Castes and Scheduled Tribes (Prevention of<\/p>\n<p>Atrocities) Act and was asked to explain the relevancy of the<\/p>\n<p>documents which he wanted to lead in this case by way of additional<\/p>\n<p>evidence. In addition, the petitioner was also asked to show if the<\/p>\n<p>documents which he wanted to lead by way of additional evidence<\/p>\n<p>would be admissible for being produced as a substantive evidence or<\/p>\n<p>not.\n<\/p>\n<p>          Two of the documents, which the petitioner wanted to<\/p>\n<p>produce by way of additional evidence, are the statements recorded<\/p>\n<p>under Section 161 Cr.P.C. not in instant case. Statement made to<\/p>\n<p>police and recorded under Section 161 Cr.P.C. can not be<\/p>\n<p>considered a substantive evidence. Such previous statements are<\/p>\n<p>available for the purpose of contradiction under Section 145 of the<\/p>\n<p>Indian Evidence Act or may be for the purpose of corroboration etc.<\/p>\n<p>The copy of the report submitted under Section 173 Cr.P.C. in<\/p>\n<p>another FIR again would not be taken as a substantive evidence<br \/>\n<span class=\"hidden_text\"> Criminal Revision No.2144 of 2008 (O&amp;M)             :3:<\/span><\/p>\n<p>which can be permitted to be led as evidence in this case. Similar<\/p>\n<p>would be the fate of enquiry report and the complaint moved by Vijay<\/p>\n<p>Kumar against Beant Singh complainant. These documents may be<\/p>\n<p>available for being used for the purpose of cross-examination to<\/p>\n<p>contradict the witness, but apparently would not be otherwise<\/p>\n<p>relevant.    The petitioner could not make any submission in this<\/p>\n<p>regard, but only stated that his prayer for leading additional evidence<\/p>\n<p>has not been properly considered.
