Considering the extent of delay, I<br \/>\nhad also with the assistance of the Counsel perused the issues<br \/>\narising in the revision application. In the revision application,<br \/>\norder dated 11.7.2006 passed by the learned Additional Sessions Judge<br \/>\nis under challenge. By the said order, learned Judge has remanded the<br \/>\nChapter Case proceedings to the Executive Magistrate who had<br \/>\npreviously closed the proceedings on the ground that civil suit<br \/>\nbetween the parties is pending and parties shall abide by the<br \/>\nultimate outcome therein.\n<\/p>\n<p>\tLearned<br \/>\nCounsel for the applicants submitted that said Civil Suit is still<br \/>\npending and in any case, the proceedings were barred by limitation.\n<\/p>\n<p>\tIt<br \/>\nwill be open for the applicants to raise all such contentions before<br \/>\nthe Executive Magistrate. However, considering that order passed by<br \/>\nlearned Additional Sessions Judge is essentially an order of remand,<br \/>\nrevision application is not entertained.
