\nlearned advocate Mr. Sunil B. Parikh for learned advocate Mr. Rajni
\nH. Mehta appearing on behalf of appellant and learned advocate Mr.
\nR.E. Variava  appearing  on  behalf of respondent Nos.1 and 2.\n<\/p>\n
2.\tThe
\nappellant ?  Insurance Company is challenging Rs.1 lakh for the
\npurpose of court fees.\n<\/p>\n
3.\tThe
\nappellant ?  Insurance Company has challenged the award passed by
\nMotor Accident Claims Tribunal, Navsari in Motor Accident Claim
\nPetition No.141 of 2005 dated 17th August 2006. The Claims
\nTribunal has awarded Rs.3,10,000\/- with 9% interest in favour of
\nrespondent claimant.\n<\/p>\n
4.\tLearned
\nadvocate Mr. Parikh raised one contention before this Court that
\nClaims Tribunal has committed error while applying multiplier looking
\nto age of deceased 34 and age of claimant 58 and 56. Therefore, he
\nsubmitted that Claims Tribunal has committed gross error in applying
\n15 multiplier even though age of claimant is 58\/56. Therefore,
\naccording to his submission, Claims Tribunal must have to apply 10
\nmultiplier instead of 15 multiplier. He relied upon recent decision
\nof Apex Court in case of Bangalore Metropolitan Transport
\nCorporation v. Sarojamma and Another reported in 2008(5)
\nACC 142.\n<\/p>\n
In the aforesaid decision, Apex Court has considered that how the
\nmultiplier will apply in case of age of deceased and in case of age
\nof claimant. The Apex Court has considered that age of claimant as
\nwell as deceased, whichever is higher, is to be considered.
\nTherefore, in view of this decision of Apex Court, looking to age of
\ndeceased 34 years and Claims Tribunal has applied 15 multiplier when
\nignored the age of claimant Dilipbhai Chhotubhai Vasi, 58 years and
\nManjulaben Dilipbhai Vasi, 54 years, the deceased was unmarried.\n<\/p>\n
5.\tTherefore,
\nin light of the Apex Court decision, according to my opinion, this
\naspect has not been properly considered by Claims Tribunal and it is
\na duty of Claims Tribunal to consider the age of claimant and age of
\ndeceased whichever is higher while applying multiplier. Looking to
\nthe facts of this case, looking to age of claimant 58\/56, then,
\naccording to my opinion, 10 multiplier would be reasonable which is
\nto be applied. Therefore, compensation for dependency benefit which
\nhas been considered by Claims Tribunal is to be reduced instead of 15
\nmultiplier, it would be applied 10 multiplier, then, amount of
\ndependency benefit is reduced from Rs.2,88,000\/- to Rs.1,92,000\/-.

\nSingh and another]<\/p>\n
6.\tAccordingly,
\nafter awarded Rs.20,000\/- for loss of estate and Rs.2,000\/- for
\nfuneral expenses, it comes to Rs.2,14,000\/-. Therefore, award passed
\nby Claims Tribunal as referred above is to be modified from
\n3,10,000\/- to Rs.2,14,000\/- with 9% interest from the date of
\napplication till the date of realisation.\n<\/p>\n
7.\tAccordingly,
\npresent appeal is partly allowed with no order as to costs.\n<\/p>\n
8.\tLearned
\nadvocate Mr. Parikh submitted that entire awarded amount including
\ncost and interest has been deposited by Insurance Company before
\nClaims Tribunal concerned.\n<\/p>\n
9.\tLearned
\nadvocate Mr. Variava submitted that order of disbursement may be
\npassed in favour of respondent claimant.\n<\/p>\n
10.\t\tLearned
\nadvocate Mr. Parikh also submitted that after passing the order of
\ndisbursement in favour of claimant, this Court may also pass
\nappropriate order of refund of remaining amount in favour of
\nappellant ?  Insurance Company.\n<\/p>\n
11.\t\tIn
\nview of aforesaid submissions made by both the learned advocates, it
\nis directed to Claims Tribunal calculate the amount of Rs.2,14,000\/-
\non the basis of 9% interest from the date of application till the
\ndate of deposit with proportionate cost by Insurance Company and
\nthen, whatever amount comes, the same shall be disbursed in favour of
\nrespondent ?  Dilipbhai Chhotubhai Vasi by account payee cheque
\nafter proper verification immediately. Rest of the amount is to be
\nrefunded to appellant ?  Oriental Insurance Company Limited by
\naccount payee cheque immediately.\n<\/p>\n
12.\t\tIn
\nview of the above order passed by this Court as above, no order is
\nrequired to be passed in Civil Application. Accordingly, Civil
\nApplication is disposed of.\n<\/p>\n
