Kashalkar,\u00a0<br \/>\nHonble Presiding Judicial Member:\n<\/p>\n<p>\u00a0<\/p>\n<p>(1)\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0<\/p>\n<p>This<br \/>\nappeal has been filed by original Complainant whose complaint was dismissed by<br \/>\nthe Forum below simply on the ground that Opposite Party had made allegation of<br \/>\nfraud against the Complainant and the question of fraud cannot be decided by the<br \/>\nForum below and therefore, Forum below without bothering to decide the complaint<br \/>\nsimply dismissed the complaint and directed the Complainant to approach Civil<br \/>\nCourt for redressal\u00a0 of his grievance.\u00a0 As such, Complainant has filed this<br \/>\nappeal.\n<\/p>\n<p>\u00a0<\/p>\n<p>(2)\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0<\/p>\n<p>Upon<br \/>\nhearing both the Advocates, we are finding that Complainant had purchased Piling<br \/>\nmachine from Opposite Party for Rs.62,438\/-.\u00a0 The payment was made by pay<br \/>\norder.\u00a0 Machine was purchased, but, since Complainant found that machine was not<br \/>\nsupplied by the Opposite Party and therefore, he filed consumer complaint<br \/>\nalleging deficiency in service on the part of the Opposite Party.\n<\/p>\n<p>\u00a0<\/p>\n<p>(3)\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0<\/p>\n<p>Opposite Party in its written statement pleaded that he made whole refund of<br \/>\nmonies to the Complainant on cancellation of the order by the Complainant, so<br \/>\nnothing was payable and complaint was absolutely false.\u00a0 He had also mentioned<br \/>\nthat there was fraud being committed by the Complainant and therefore, he<br \/>\npleaded that complaint should be dismissed with costs.\n<\/p>\n<p>\u00a0<\/p>\n<p>(4)\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0<\/p>\n<p>The<br \/>\nForum below upon observing that there was allegation of fraud made by the<br \/>\nOpposite Party in his written statement, simply passed order of dismissal and<br \/>\ndirected Complainant to approach Civil Court. Aggrieved by this order, the<br \/>\noriginal Complainant has filed this appeal.\n<\/p>\n<p>\u00a0<\/p>\n<p>(5)\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0<\/p>\n<p>Upon<br \/>\nhearing both the Advocates we are finding that the Forum below has resorted to<br \/>\nshortcut method.\u00a0 In fact there was nothing in the complaint lodged in the Forum<br \/>\nbelow which would have prevented Forum below from deciding the complaint on<br \/>\nmerit.\u00a0 It was simply case of non-delivery of machine despite full payment made<br \/>\nby the Complainant.\u00a0 Whereas the contention of the Opposite Party in his written<br \/>\nstatement was that, since machine was not acceptable to the Complainant he had<br \/>\nrefunded the full amount to the Complainant.\u00a0 So, this is purely a case of<br \/>\nallegation of non-delivery of machine by the Complainant and counter allegation<br \/>\nof the Opposite Party that he had refunded the monies back, so this was simply<br \/>\ncase which could have been decided by the Forum below, but, Forum below thought<br \/>\nit fit to direct Complainant to approach Civil Court, saying that complaint<br \/>\ninvolved allegation of fraud.\u00a0 We are finding that the order passed by the Forum<br \/>\nbelow is per se bad in law and cannot be sustainable in law.\u00a0 This type of<br \/>\nrejection of the complaint by the Forum below by its impugned judgement dated<br \/>\n12.03.2010 is improper and therefore, by allowing this appeal, the order passed<br \/>\nby the Forum below will have to be quashed and complaint will have to be<br \/>\nremitted back to Forum below for deciding the complaint in accordance with law.\u00a0<br \/>\nHence, we pass the following order:\n<\/p>\n<p>\u00a0<\/p>\n<p> O\u00a0<br \/>\nR\u00a0 D\u00a0 E\u00a0 R<\/p>\n<p>\u00a0<\/p>\n<p>\u00a0 (i)\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0<\/p>\n<p>Appeal<br \/>\nis allowed.\n<\/p>\n<p>\u00a0<\/p>\n<p>(ii)\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0<\/p>\n<p>Impugned order of rejection of complaint is quashed and set aside.\n<\/p>\n<p>\u00a0<\/p>\n<p>(iii)\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0<\/p>\n<p>Complaint No.320\/2009 is remitted back to District Consumer Disputes Redressal<br \/>\nForum, Nashik.\n<\/p>\n<p>\u00a0<\/p>\n<p>(iv)\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0<\/p>\n<p>Both<br \/>\nparties are directed to appear in the Forum below on  <\/p>\n<p>28\/09\/2010.\n<\/p>\n<p>\u00a0<\/p>\n<p>(v)\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0<\/p>\n<p>Forum<br \/>\nbelow shall decide the complaint on merit and Forum below is expected to dispose<br \/>\nof the complaint within 60 days from the date of appearance of the parties<br \/>\nbefore the Forum below.\n<\/p>\n<p>\u00a0<\/p>\n<p>(vi)\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0<\/p>\n<p>Parties are left to bear their own costs.\n<\/p>\n<p>\u00a0<\/p>\n<p>\u00a0<\/p>\n<p>\u00a0 (S.P.
