(Oral)\n<\/pre>\n<p>         The present petition has been preferred under Section       438<\/p>\n<p>Cr.P.C. seeking pre-arrest bail to the petitioners in case FIR No. 312<\/p>\n<p>dated 24.7.2008 registered at Police Station Civil Lines, Karnal, under<\/p>\n<p>Sections 406, 420, 506, &amp; 120-B IPC.\n<\/p>\n<p>         On 5.5.2009, this Court had passed the following order:-<\/p>\n<blockquote><p>                             &#8220;Counsel has submitted that in the present<\/p>\n<p>                    case, complainant Anil Kadiyan is an Advocate. He<\/p>\n<p>                    had entered in an agreement to sell with Lal Singh at<\/p>\n<p>                    the instance of Mitter Pal. Counsel has submitted<br \/>\n<span class=\"hidden_text\"> Criminal Misc. No. M-12204 of 2009                                   2<\/span><\/p>\n<p>                   that petitioners are only attesting witnesses to the<\/p>\n<p>                   agreement to sell. The allegation that even though<\/p>\n<p>                   Lal Singh had received the earnest money, had<\/p>\n<p>                   failed to execute the agreement to sell, will not<\/p>\n<p>                   fasten the petitioners    with any criminal liability.<\/p>\n<p>                   Counsel has further submitted that observations<\/p>\n<p>                   made in the impugned order that the petitioners<\/p>\n<p>                   were witnesses to various agreements to sell will not<\/p>\n<p>                   hold them liable for commission of any criminal act.<\/p>\n<\/blockquote>\n<blockquote><p>                                       Issue notice of motion for 15th<\/p>\n<p>                   May, 2009.\n<\/p><\/blockquote>\n<blockquote><p>                             In the event of arrest, petitioners shall be<\/p>\n<p>                   released on interim bail to the satisfaction of the<\/p>\n<p>                   arresting officer. However, petitioners shall join<\/p>\n<p>                   investigation as and when called for. Petitioners<\/p>\n<p>                   shall abide by the conditions specified under Section<\/p>\n<p>                   438(2) Cr.P.C.&#8221;\n<\/p><\/blockquote>\n<p>         Today, Mr. S.S. Patter, Senior Deputy Advocate General,<\/p>\n<p>Haryana, has stated that on basis of first agreement to sell, about 30<\/p>\n<p>agreements to sell have been executed and petitioners are party to the<\/p>\n<p>conspiracy to dupe various persons.\n<\/p>\n<p>         Counsel for the State has stated that investigation will be<\/p>\n<p>completed and final report under Section 173 Cr.P.C. will be submitted<\/p>\n<p>within 15 days from today.\n<\/p>\n<p>         Since the final report under Section 173 Cr.P.C. will be<\/p>\n<p>submitted within 15 days, petitioners are allowed to remain on pre-arrest<br \/>\n<span class=\"hidden_text\"> Criminal Misc. No. M-12204 of 2009                                     3<\/span><\/p>\n<p>bail.
