APP  for\nRespondent : 1, \nRULE SERVED for Respondent : 2, \nMR RC KAKKAD\nfor Respondent : 2, \n=================================================\n\n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE S.R.BRAHMBHATT\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 23\/02\/2011 \n\n \n\n \n \nORAL\nJUDGMENT<\/pre>\n<p>\tHeard<br \/>\nlearned advocate for the parties.\n<\/p>\n<p>Learned<br \/>\n\tadvocate appearing for the original complainant has sought<br \/>\n\tpermission of this Court for placing on record the communication<br \/>\n\treceived by him from the said complainant, namely Dineshkumar<br \/>\n\tKarsandas Gandecha that the dispute is amicably settled and he is<br \/>\n\tnot desirous of prosecuting further the criminal case No. 307\/2005,<br \/>\n\tand in view of this, if the Criminal Misc. Application No. 14197 of<br \/>\n\t2005 is allowed he shall have no objection, meaning thereby the<br \/>\n\tcomplaint be quashed.\n<\/p>\n<p>The<br \/>\n\toriginal complaint came to be filed by original complainant \/<br \/>\n\trespondent no.2 herein being Criminal Case No. 307\/2005 alleging<br \/>\n\tthat the accused therein have committed offence punishable under<br \/>\n\tsection 406, 420 read with section 114 of I.P. Code. The entire<br \/>\n\ttenor of the complaint also go to show that it was essentially a<br \/>\n\tcivil dispute which was sought to be made subject matter of<br \/>\n\tcomplaint. Though the Court needs to be mindful of the fact that<br \/>\n\tunder provision of Section 420 the complainant does not have sole<br \/>\n\tdiscretion to withdraw or not to press the complaint. However in<br \/>\n\tview of the Apex Court decision in case of NIKHIL MERCHANT Vs.<br \/>\n\tCENTRAL BUREAU OF INVESTIGATION AND ANOTHER, reported in 2009 (1)<br \/>\n\tG.L.H. 31, that the complaint even if it is permitted to be brought<br \/>\n\tto its logical end, then it is not likely to serve interest of<br \/>\n\tjustice, rather it is going to be counter productive, in as much as,<br \/>\n\tthe peace arrived at by the parties will get disturbed thereby.<br \/>\n\tHence quashing is required to be ordered. Accordingly the complaint<br \/>\n\tbeing Criminal Case No. 307\/2005 is hereby quashed.  Petition is<br \/>\n\tallowed.
