On<br \/>\n19th January 2002 he consumed liquor and misbehaved with<br \/>\nother persons. In  pursuance of this incident a chargesheet came to<br \/>\nbe issued and after conducting departmental inquiry a punishment of<br \/>\nstoppage of five increments has been imposed upon the respondent.<br \/>\nHowever, the reviewing authority vide order dated 11th<br \/>\nFebruary 2003 dismissed him from service. The respondent therefore<br \/>\nraised a dispute  which was referred to the Labour Court wherein the<br \/>\naforesaid judgement and award came to be passed.\n<\/p>\n<p>3.\tHeard<br \/>\nthe learned Advocates for the respective parties and perused the<br \/>\nrelevant record. As a result of this exercise it is found that in the<br \/>\ninquiry the crucial witnesses were not examined and the guilt was not<br \/>\nproved. In any case it was not a case for imposing extreme punishment<br \/>\nof dismissal from service. At the same time, there are 19 past<br \/>\ndefaults against the respondent and the Labour Court ought to have<br \/>\nimposed some punishment upon the respondent. Ordinarily the matter<br \/>\nought to have remanded to the Labour Court. However, the reference is<br \/>\nof the year 2004 and it may take another few years to decide the<br \/>\nmatter. Therefore, having considered all the facts and circumstances<br \/>\nof the case I am of the view that ends of justice would be met by<br \/>\nimposing a penalty of stoppage of three increments  with future<br \/>\neffect. Further there there was no justification for grant of back<br \/>\nwages especially when the respondent has not worked during the<br \/>\ninterregnum period.\n<\/p>\n<p>4.\tIn<br \/>\nthe premises aforesaid, the judgement and award of the Labour Court<br \/>\nis quashed and set aside qua back wages. Further a penalty of<br \/>\nstoppage of three increments with future effect shall be imposed upon<br \/>\nthe respondent.
