S.J.MUKHOPADHAYA)<\/p>\n<p>\tThe<br \/>\npetitioner &#8211; Association is representing the fishermen of<br \/>\nSalaya, District Jamnagar. The grievance is that respondent no.4 is<br \/>\nconstructing jetty over the marine sanctuary resulting into<br \/>\ndestruction of marine life, flora and fauna, namely, Salaya Marine<br \/>\nNational Park and Sanctuary. It is further alleged that if the jetty<br \/>\nis allowed to be constructed, it would result into loss of occupation<br \/>\nof about 8,000 fishermen and thereby 8,000 families of 14 villages of<br \/>\nSalaya Taluka will lose their occupation.\n<\/p>\n<p>\tOn<br \/>\nappearance, respondent no.4 has taken a plea that it has not started<br \/>\nany activity in the forest land admeasuring 4.6 hectare, for which<br \/>\npermission from the Department of Environment and Forests, Government<br \/>\nof India is awaited. The Company will not start any activity in this<br \/>\narea till such permission is received, and as and when granted, it<br \/>\nwould strictly abide by the terms and conditions imposed while<br \/>\ngranting the permission. It is informed that no mangrove trees have<br \/>\nbeen cut or damaged.\n<\/p>\n<p>\tLearned<br \/>\ncounsel appearing on behalf of respondent no.4 would submit that<br \/>\njetty is under construction in a non-forest area in terms with the<br \/>\nEnvironmental and CRZ clearance granted by the Government of India,<br \/>\nMinistry of Environment and Forests.\n<\/p>\n<p>\tIn<br \/>\nthe fact and circumstance, we allow two weeks time to the Union of<br \/>\nIndia, Ministry of Environment and Forests, New Delhi to file<br \/>\naffidavit and state as to whether any permission has been granted for<br \/>\nany construction including jetty in the coastal area which may affect<br \/>\nthe marine life, flora and fauna of Salaya Marine National Park and<br \/>\nSanctuary.\n<\/p>\n<p>\tPost<br \/>\nthe matter on 11th October 2011 within five cases.\n<\/p>\n<p>\tUntil<br \/>\nfurther order, respondent no.4 will not make any construction over<br \/>\nthe Marine Sanctuary and shall not destruct any marine life, flora<br \/>\nand fauna of Salaya Marine National Park and Sanctuary. They are<br \/>\nprohibited from cutting the mangrove trees from any of the areas<br \/>\nincluding the area for which the permission has been granted and<br \/>\nshall not fill up any area affecting the mangrove trees.
