Respondents\n\nPrayer\n\nPetition filed under Article 226 of the Constitution of India, praying\nfor the issuance of a Writ of Mandamus, directing the first respondent to\nconsider and pass orders on the petitioner's appeal petition dated 09.02.2010\nwithin a reasonable time period to be fixed by this Hon'ble Court.\n\n!For petitioner  ... Mr.R.Manoharan\n    \t\t     Government Pleader\n\n:ORDER\n<\/pre>\n<p>\tHeard Mr.N.Dilip Kumar, the learned counsel appearing on behalf of the<br \/>\npetitioner, as well as Mr.R.Manoharan, the learned Government Advocate appearing<br \/>\non behalf of the respondents.\n<\/p>\n<p>\t2. At this stage of the hearing of the writ petition, the learned counsel<br \/>\nappearing on behalf of the petitioner had submitted that it would suffice, if<br \/>\nthe appeal of the petitioner, dated 09.02.2010, is directed to be disposed of,<br \/>\non merits and in accordance with law, within a specified period.\n<\/p>\n<p>\t3. The learned Government Advocate appearing on behalf of the respondents,<br \/>\nhas no objection for such an order being passed by this Court.\n<\/p>\n<p>\t4. In view of the averments made in the affidavit filed in support of this<br \/>\npetition and in view of the submissions made by the learned counsel appearing on<br \/>\nbehalf of the petitioner, the first respondent is directed to consider and<br \/>\ndispose of the petitioner&#8217;s appeal, dated  09.02.2010, on merits and in<br \/>\naccordance with law, after giving an opportunity of hearing to the petitioner,<br \/>\nthe fourth respondent, as well as to the other persons concerned, as<br \/>\nexpeditiously as possible, not later than four months from the date of receipt<br \/>\nof a copy of this order.  The petitioner is directed to submit a copy of the<br \/>\nappeal, dated 09.02.2010, along with a copy of this order, to the first<br \/>\nrespondent. However, it is made clear, that this Court, by this order, has not<br \/>\nexpressed any opinion on the merits of the matter.\n<\/p>\n<p>\t5. The writ petition stands disposed of, with the above directions.
