Justice K.K.DENESAN\n\n Dated :13\/03\/2007\n\n O R D E R\n                                 K.K.DENESAN, J\n\n                        -----------------------------------------\n\n                        W.P.(C)NO. 8308 of 2007\n\n                        -----------------------------------------\n\n\n\n             Dated this the 13th  day  of  March,  2007\n\n\n\n                                   JUDGMENT\n<\/pre>\n<p>      The   petitioner   is   working   as   Junior   Health   Inspector<\/p>\n<p>Grade-II     in   the   Health   Services   Department.   The   writ   petition<\/p>\n<p>shows   that   he   possesses   the   qualifications   of   B.Com.,   MSW,<\/p>\n<p>Health   Inspectors  Diploma   awarded  by  the  All  India  Institute  of<\/p>\n<p>Local Self Government, Bombay, M.Sc.(Psychology) and M.Phil in<\/p>\n<p>Psychology. He passed the State Eligibility Test conducted by the<\/p>\n<p>Government of Kerala.\n<\/p>\n<p>      2. The Kerala State Institute of Health and Family  Welfare<\/p>\n<p>and Collaborating Training Institute lacks  the required number of<\/p>\n<p>faculty   members   since   the   leaving   of   two   members   who   were<\/p>\n<p>earlier   engaged   in   that   Institute.     The   necessity   to   engage<\/p>\n<p>faculty   members   has   been   felt   by   the   Principal   of   the   Institute<\/p>\n<p>who   has   already   addressed   the   Director   of   Health   Services.   In<\/p>\n<p>Ext.P4   communication   dated   23.9.2006,   the   Principal   has<\/p>\n<p><span class=\"hidden_text\">W.P.(C)No.8308\/2007                                            :2:<\/span><\/p>\n<p>recommended   the   name   of   the   petitioner   to   be   engaged   as   a<\/p>\n<p>member   of   the   faculty   considering   his   qualifications,   teaching<\/p>\n<p>experience   etc.   The   petitioner   has   also   filed   a   representation<\/p>\n<p>evidenced   by   Ext.P3   addressed   to   the   Secretary,   Health   and<\/p>\n<p>Family Welfare Department through a proper channel.\n<\/p>\n<p>        3. No decision has been taken on Ext.P4. Details relating to<\/p>\n<p>the   service   particulars   of   the   petitioner   are   known   to   the   first<\/p>\n<p>respondent since Ext.P3 was routed through proper channel. The<\/p>\n<p>reliefs   prayed   for   in   this   writ   petition   include   a   direction   to   the<\/p>\n<p>first respondent to consider and pass orders on Ext.P4 forthwith.\n<\/p>\n<p>        4.   I   have   heard   the   Government   Pleader   for   the   first<\/p>\n<p>respondent. In the nature of the order I propose to pass, notice<\/p>\n<p>need not be issued, at this stage, to the second respondent.\n<\/p>\n<p>        5.     Having   regard   to   the   fact   that   there   is   no   faculty<\/p>\n<p>members and having felt the need for faculty members as seen<\/p>\n<p>from the recommendation made  by the Principal of the Institute,<\/p>\n<p>it   is   only   appropriate   that   the   first   respondent   takes   up   for<\/p>\n<p>consideration  Ext.P4     and   passes   orders  in   accordance  with  law<\/p>\n<p>as early as possible. A time limit of three weeks  from the date of<\/p>\n<p><span class=\"hidden_text\">W.P.(C)No.8308\/2007                                            :3:<\/span><\/p>\n<p>receipt of a copy of the judgment is fixed for passing orders on<\/p>\n<p>Ext.P4.   I   make   it   clear   that   I   have   not   expressed   any   opinion<\/p>\n<p>about   the   merits   of   the   contentions   of   the   petitioner.
