JUSTICE ABHILASHA KUMARI\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 19\/07\/2010 \n\n \n\n \nORAL\nORDER<\/pre>\n<p>(Per<br \/>\n: HONOURABLE MR.JUSTICE JAYANT PATEL)<\/p>\n<p>The<br \/>\n\tpresent petition under the Contempt of Court Act is for<br \/>\n\tnon-compliance to the order passed by this Court dated 27.01.2009 in<br \/>\n\tSCA No.16121\/05, whereby the amount of gratuity was ordered to be<br \/>\n\tpaid with interest at the rate of 12% p.a. and the cost of<br \/>\n\tRs.5,000\/-.\n<\/p>\n<p>Today<br \/>\n\twhen the matter is further taken up for hearing, it has been stated<br \/>\n\tby the learned AGP that the amount of Rs.4,78,185\/- has already been<br \/>\n\tdeposited and it has been stated that the amount of interest and<br \/>\n\tcosts has been included.  It appears that as per the office report,<br \/>\n\tthe amount has been deposited.  We have heard the learned counsel<br \/>\n\tfor both the sides on the aspects of withdrawal.  This Court in the<br \/>\n\taforesaid order dated 27.01.2009, at para 9, after giving the<br \/>\n\tdirections, had further observed as under:\n<\/p>\n<p>&#8220;However,<br \/>\nit is clarified that such payment shall be subject to the view, if<br \/>\nany, may be taken by the Division Bench of this Court in LPA No.1155<br \/>\nof 2005.  The petitioner, if desirous, may get himself impleaded as<br \/>\nparty in the proceedings of LPA by moving suitable application, since<br \/>\nthe decision of the LPA Bench may affect the rights of the petitioner<br \/>\nin the event the LPA Bench reverse the orders passed by the learned<br \/>\nSingle Judge in Special Civil Application No.14636 of 2003.&#8221;\n<\/p>\n<p>It<br \/>\n\tmay also be recorded that in the proceedings of LPA No.1155\/05, the<br \/>\n\tLPA Bench of this Court had directed the appellant State Government<br \/>\n\tto pay the amount of gratuity in terms of the direction of this<br \/>\n\tCourt, but subject to the final adjudication of the appeal.\n<\/p>\n<p>Under<br \/>\n\tthese circumstances, any resistance or objection raised by<br \/>\n\trespondent for not permitting the applicant to withdraw the amount<br \/>\n\tcan hardly be sustained.  At the most, the petitioner may be<br \/>\n\trequired to comply with the condition as was imposed by this Court<br \/>\n\tin the order dated 27.01.2009 to the effect that in the event the<br \/>\n\tLPA Bench reverses the order passed by the learned Single Judge in<br \/>\n\tSCA No.14636\/03 and it is so directed by this Court, he shall refund<br \/>\n\tthe amount at par with the petitioners of SCA No.14636\/03 decided<br \/>\n\tvide order dated 03.02.2005 and similar matters.\n<\/p>\n<p>Hence,<br \/>\n\tit is directed as under:\n<\/p>\n<p>The<br \/>\n\tpetitioner shall file an undertaking to this Court that in the event<br \/>\n\tLPA Bench of this Court reverses the view taken by this Court in SCA<br \/>\n\tNo.14636\/03, by remaining at par with the petitioners therein and it<br \/>\n\tis so directed by this Court, the petitioner shall refund the amount<br \/>\n\tto the concerned authority.  Such undertaking shall be filed within<br \/>\n\ttwo weeks from today.\n<\/p>\n<p>Upon<br \/>\n\tfiling of such undertaking, the petitioner shall be permitted to<br \/>\n\twithdraw the amount of Rs.4,75,185\/-.\n<\/p>\n<p>Upon<br \/>\n\tcompliance of the aforesaid two directions, the disobedience of the<br \/>\n\torder would no more survive and the present proceeding shall stand<br \/>\n\tdisposed of accordingly.
