SANKARAN, J.\n                   ---------------------------\n                    B.A. No.1075 of 2010\n               ------------------------------------\n            Dated this the 19th day of February, 2010\n\n                           O R D E R\n<\/pre>\n<p>       This is an application for bail under Section 439 of the<\/p>\n<p>Code of Criminal Procedure.     Petitioners are accused Nos. 17<\/p>\n<p>and 18 in Crime No.821\/2009 of Kasaragod Police Station.<\/p>\n<p>       2. The offences alleged against the petitioners are under<\/p>\n<p>Sections 143, 147, 148, 342, 353, 332 and 395 read with<\/p>\n<p>Section 149 of the Indian Penal Code and Section 3(1) of the<\/p>\n<p>PDPP Act.\n<\/p>\n<p>       3. The date of occurrence was on 15\/11\/2009. The<\/p>\n<p>petitioners   were    arrested   in    connection  with   Crime<\/p>\n<p>No.816\/2009 of Kasaragod Police Station on 4\/1\/2010 and their<\/p>\n<p>formal arrest was recorded in the present case on 8\/2\/2010.<\/p>\n<p>       4. As per the order dated 10\/2\/2010 in B.A. Nos.216<\/p>\n<p>and 431 of 2010, bail was granted by this Court to accused<\/p>\n<p>Nos.9,11, 12 and 13.\n<\/p>\n<p>       5. Taking into account the facts and circumstances of the<\/p>\n<p>case, the duration of the judicial custody undergone by the<\/p>\n<p>petitioners, the nature of the offence and also taking into<\/p>\n<p>B.A. No.1075 \/2010<br \/>\n<span class=\"hidden_text\">                                  2<\/span><\/p>\n<p>account the fact that some other accused persons were granted<\/p>\n<p>bail as aforesaid, I am inclined to grant bail to the petitioners.<\/p>\n<p>        6. The petitioners shall be released on bail on their<\/p>\n<p>executing bond for Rs. 50,000\/- each with two solvent sureties<\/p>\n<p>each for the like amount to the satisfaction of the Judicial<\/p>\n<p>Magistrate of the First Class- I, Kasaragod subject to the<\/p>\n<p>following conditions:-\n<\/p>\n<blockquote><p>              A)   The petitioners shall report before the<br \/>\n                  Investigating Officer between 9 A.M. and<br \/>\n                  11 A.M. on all Mondays and Thursdays, till<br \/>\n                  the final report is filed or until further<br \/>\n                  orders;\n<\/p><\/blockquote>\n<blockquote><p>              B)   The petitioners shall   appear before the<br \/>\n                  Investigating Officer for interrogation as<br \/>\n                  and when required;\n<\/p><\/blockquote>\n<blockquote><p>              C)  The petitioners shall not enter into the<br \/>\n                  limits of Kasaragod Police Station for a<br \/>\n                  period   of   three   months     except    for<br \/>\n                  complying with conditions A and B;\n<\/p><\/blockquote>\n<blockquote><p>              D)  The petitioners shall        surrender their<br \/>\n                  passports before the Court of the Judicial<br \/>\n                  Magistrate of the First Class-I, Kasaragod<br \/>\n                  within one week. If any one of the<br \/>\n                  petitioners does not hold an Indian<br \/>\n                  Passport, an affidavit to that effect, sworn<br \/>\n                  to by him shall be filed before the learned<br \/>\n                  Magistrate within one week;\n<\/p><\/blockquote>\n<p>B.A. No.1075 \/2010<br \/>\n<span class=\"hidden_text\">                                   3<\/span><\/p>\n<p>              E)   The petitioners shall not try to influence<br \/>\n                  the prosecution witnesses or tamper with<br \/>\n                  the evidence;\n<\/p>\n<p>              F) The petitioners shall not commit any offence<br \/>\n                  or indulge in any prejudicial activity while<br \/>\n                  on bail.\n<\/p>\n<p>              G)  In case of breach of any of the conditions<br \/>\n                  mentioned       above   by   any   of   the<br \/>\n                  petitioners, the bail granted to them shall<br \/>\n                  be liable to be cancelled.\n<\/p>\n<p>        The Bail Application is allowed as above.<\/p>\n<p>                                    K.T.
