     This appeal preferred by the Government<\/p>\n
pertains to acquisition of land in Nedumangadu village<\/p>\n
for the purposes of establishment of E.E.C Market at<\/p>\n
Nedumangadu. The relevant Section 4(1) notification<\/p>\n
was published on 16\/06\/92. The Awarding Officer<\/p>\n
categorised    the     properties        under acquisition    to<\/p>\n
categories (A) to (F) on the basis of frontage\/access of<\/p>\n
of main road, edavazhy nearest to main road etc. For<\/p>\n
properties in (A) category, the Land Acquisition Officer<\/p>\n
has awarded land value at Rs.15,992\/- per Are and for<\/p>\n
other categories, he awarded land value at the rates<\/p>\n
given below:-\n<\/p>\n

           (B) category    -    Rs.12,794\/-\n\n\n           (c) category    -    Rs.10,235\/-\n\n\n           (d) category    -    Rs.9,211\/-\n\n\n           (e) category    -    Rs.8,750\/-\/-\n\n\n           (f) category    -    Rs.7,438\/-\n\n\n<\/pre>\n
           The   evidence   before  the   Reference  Court<\/p>\n
      consisted mainly of Exts.A4, A6, A7, A9, A12 and A14<\/p>\n
      judgments of the Nedumangadu Sub Court in respect<\/p>\n
      of the second phase of acquisition for the same<\/p>\n
      purpose. Thus, the properties in Exts.A4, A6, A7, A9,<\/p>\n
      A12 and A14 were properties lying adjacent to the<\/p>\n
      acquired properties in this case. The Nedumangadu<\/p>\n
      Sub Court, which had occasion to decide the cases<\/p>\n
      pertaining to acquisition of the second phase even<\/p>\n
      earlier than the impugned judgments were passed,<\/p>\n
      had granted 220% enhancement over the rates given<\/p>\n

      by the Awarding Officer in those acquisitions which<\/p>\n
      were on the basis of Section 4(1) notification<\/p>\n
      published one year after the notification in this case.<\/p>\n
      In fact, in those judgments, the Sub Court had relied<\/p>\n
      on a document which is produced in those cases as<\/p>\n
      Ext.A1. Ext.A1 in those cases was a sale deed in<\/p>\n
      favour of LIC of India in respect of 10.5 cents of land<\/p>\n
      in Nedumangadu village situated very near to the<\/p>\n
      acquired properties in this case. Ext.A1 document<\/p>\n
      revealed the land value of Rs.44,000\/- per cent. What<\/p>\n
      the Reference Court has done in Exts.A4, A6, A7, A9,<\/p>\n
      A12 and A14, was to award amounts lesser than the<\/p>\n
      rates reflected in Exts.A1 in those cases. It is not<\/p>\n
      difficult for us to hold that Exts.A4, A6, A7, A9, A12<\/p>\n
      and A14 had considerable probative value in these<\/p>\n
      cases since the properties were situated adjacently<\/p>\n

      and the acquisition was for the same purposes though<\/p>\n
      one year later. The Reference Court rightly relied on<\/p>\n
      these judgments and granted proportionate increase<\/p>\n
      to the properties included in all the categories. Thus,<\/p>\n
      220% increase was given under the impugned<\/p>\n
      judgments over the rates awarded by the Land<\/p>\n
      Acquisition Officer.\n<\/p>\n<\/p>\n
           It is brought to our notice that the appeals<\/p>\n
      preferred by the Government against Exts.A4, A6, A7,<\/p>\n
      A9, A12 and A14 were dismissed by this Court by<\/p>\n
      judgments 06\/10\/04 and 01\/07\/05 respectively in<\/p>\n
      LAA.620\/2000 and LAA.1561\/2000 series. Copies of<\/p>\n
      those judgments are also produced before us for<\/p>\n
      perusal. Those judgments show that this Court<\/p>\n
      confirmed the enhancement given to the claimants<\/p>\n
      under Exts.A4, A6, A7, A9, A12 and A14 and allowed<\/p>\n

      the cross objections filed by the claimants to the<\/p>\n
      extent of granting statutory benefit to the claimants.<\/p>\n
      Thus, Exts.A4, A6, A7, A9, A12 and A14 have attained<\/p>\n
      finality. In view of the finality attained by those<\/p>\n
      judgments, we do not find any ground for interfering<\/p>\n
      with the impugned judgments at the instance of the<\/p>\n
      Government.\n<\/p>\n<\/p>\n
            The appeals preferred by the Government will<\/p>\n
      stand dismissed. No costs.\n<\/p>\n<\/p>\n
