Modi, learned advocate waives service of rule on behalf<br \/>\nof respondent no.1-claimant, who is the main contesting party. The<br \/>\nother opponents, viz. driver and owner of the vehicle involved in the<br \/>\naccident are not going to be adversely affected by the order which<br \/>\nmay be passed in this Civil Application.\n<\/p>\n<p>2.\tThe<br \/>\napplicant- appellant- Insurance Company has already deposited the<br \/>\nentire amount of the award with interest and cost. The Insurance<br \/>\nCompany has deposited, in all, Rs.1,06,580\/-.  At the first instance,<br \/>\nRs.25,000\/- has been deposited for &#8216;no fault liability; thereafter,<br \/>\nRs.25,000\/- has been deposited under section 173 of the Motor<br \/>\nVehicles Act; and finally, Rs.56,680\/- has been deposited during the<br \/>\npendency of this appeal.\n<\/p>\n<p>Taking into<br \/>\nconsideration the fact that it is an injury case and the claimant is<br \/>\nan agriculturist, the Tribunal is directed to deposit the aforesaid<br \/>\namount in a Cumulative Fixed Deposit Account of any Nationalized Bank<br \/>\nin the name of  respondent \/claimant, initially for a period of three<br \/>\nyears  with periodical renewals till the appeal is<br \/>\nfinally decided by this Court. Though the amount is deposited in the<br \/>\nname of the respondent\/ claimant, the Fixed Deposit Receipt shall<br \/>\nremain with the Nazir of the Claims Tribunal till the appeal is<br \/>\nfinally decided by this Court.\n<\/p>\n<p>The Tribunal is<br \/>\nalso directed to allow withdrawal of the interest amount accruing on<br \/>\nthe fixed deposit to the claimants every quarter on proper<br \/>\nverification.\n<\/p>\n<p>3.\tWith the<br \/>\nabove directions, the Civil Application is disposed of.
