He, therefore, submitted that<br \/>\n\tthe present application may be allowed.\n<\/p>\n<p>Learned<br \/>\n\tA.P.P., Mr.Poojari resisted the present application. He referred to<br \/>\n\tthe testimony of the victim and emphasized that it was because of<br \/>\n\tthe treat, she may not have stated, but whatsoever she has stated is<br \/>\n\tcorroborated by other evidence including the history given before<br \/>\n\tthe doctor. He, therefore, submitted that the present application<br \/>\n\tmay not be entertained.\n<\/p>\n<p>In<br \/>\n\tview of the rival submissions, it is required to be considered<br \/>\n\twhether the present application can be entertained or not.\n<\/p>\n<p>As<br \/>\n\tthis Court is not required to consider and scrutinize the evidence<br \/>\n\tin detail at this stage. However, for considering the aspect of<br \/>\n\tsuspension of sentence under Section 389 of the Code of Criminal<br \/>\n\tProcedure for releasing the applicant on bail, the nature of<br \/>\n\toffence, role and other evidence is required to be considered along<br \/>\n\twith the guidelines laid down by the pronouncement of the Apex Court<br \/>\n\tunder Section 389 of the Code of Criminal Procedure. Having regard<br \/>\n\tto the testimony of the witnesses and other evidence, it would be in<br \/>\n\tthe fitness of things to allow the present application.\n<\/p>\n<p>Accordingly,<br \/>\n\tthe present application stands allowed. Substantive sentence imposed<br \/>\n\tby the  Learned Special Judge, Additional Sessions Judge,<br \/>\n\t(F.T.C.No.2), Bhavnagar in Special (Atrocity) Case No.31 of 2006 as<br \/>\n\tper Judgment &amp; Order dated 24.06.2010 shall remain under<br \/>\n\tsuspension till final hearing and disposal of this appeal and the<br \/>\n\tapplicant-accused is ordered to be released on bail on his executing<br \/>\n\ta bond of Rs.10,000\/- (Rupees Ten Thousand Only) with one solvent<br \/>\n\tsurety of the like amount to the satisfaction of the lower Court and<br \/>\n\tsubject to the conditions that he shall:\n<\/p>\n<p>(a)\tnot<br \/>\ntake undue advantage of his liberty or abuse his liberty.\n<\/p>\n<p>(b)\tnot<br \/>\nto try to tamper with the evidence or pressurize the prosecution<br \/>\nwitnesses or complainant in any manner.\n<\/p>\n<p>(c)\tmaintain<br \/>\nlaw and order.\n<\/p>\n<p>(d)\tsurrender<br \/>\nhis passport, if any, to the lower Court, within a week.\n<\/p>\n<p>Rule<br \/>\n\tis made absolute to the aforesaid extent.
