Justice V.GIRI\n\n Dated :04\/12\/2008\n\n O R D E R\n                              V.GIRI,J.\n                       -------------------------\n                  W.P ( C) No.35773 of 2008\n                       --------------------------\n             Dated this the 4th December, 2008\n\n                         J U D G M E N T\n<\/pre>\n<p>     Petitioner    is   an    Agriculturist      having    paddy<\/p>\n<p>cultivation in the fields at Kuttanad in the southern side of<\/p>\n<p>the Anattupuram-Choothanadi paddy field. Respondents<\/p>\n<p>5 and 6 are the inhabitants residing adjacent to the<\/p>\n<p>Vachal   Thodu     which     is   used    for    irrigation and<\/p>\n<p>transportation purposes by the agriculturists having<\/p>\n<p>access to the said Vachal Thodu. It seems that there is<\/p>\n<p>obstruction caused to Vachal Thodu by respondents 5 and<\/p>\n<p>6 resulting in    inadequate flow of water to the paddy<\/p>\n<p>fields.  This was brought to the notice of            RDO vide<\/p>\n<p>Exhibit P2 representation. An enquiry was conducted by<\/p>\n<p>the 4th respondent as per the directions of the RDO, who<\/p>\n<p>as per Exhibit P3 came to the conclusion that respondents<\/p>\n<p>5 and 6 had filled up the Vachal Thodu. Thereafter, 2nd<\/p>\n<p>respondent directed the 3rd respondent to take steps in<\/p>\n<p>accordance with provisions of the Kerala Land Utilisation<\/p>\n<p>W.P ( C) No.35773 of 2008<br \/>\n<span class=\"hidden_text\">                                 2<\/span><\/p>\n<p>Act and     this was conveyed to the 4th respondent vide<\/p>\n<p>Exhibit P5.\n<\/p>\n<p>     2.    Petitioner&#8217;s grievance is regarding the delay in<\/p>\n<p>implementation of the direction issued under Exhibit P5.<\/p>\n<p>Exhibit P6 representation has been filed before the District<\/p>\n<p>Collector who is obviously competent to see that the lawful<\/p>\n<p>direction issued by a subordinate authority is implemented<\/p>\n<p>by him.\n<\/p>\n<p>     3.
