DAVE\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 01\/04\/2011 \n\n \n\n \n \nORAL\nORDER<\/pre>\n<p>RULE.\n<\/p>\n<p>\tLearned APP Mr. AJ Desai waives service of notice of Rule for the<br \/>\n\trespondent &#8211; State.\n<\/p>\n<p>This<br \/>\n\tapplication is filed under Section 438 of the Code of Criminal<br \/>\n\tProcedure in connection with First Information Report registered as<br \/>\n\tI-C.R. No.19\/2011 with Jalalpore Police Station, Navsari for the<br \/>\n\toffences punishable under Sections 465, 466, 468, 471, 474, 475 and<br \/>\n\t120B of the Indian Penal Code.\n<\/p>\n<p>Learned<br \/>\n\tCounsel for the applicant submits that without<br \/>\n\tprejudice to the rights and contentions of the applicant, the amount<br \/>\n\tof the loan was already paid and the account is declared closed as<br \/>\n\tper the statement of account produced at Annexure C to this<br \/>\n\tpetition.   It is the case of the applicant that he was duped by one<br \/>\n\tagent.   It is further submitted that in view of the above,<br \/>\n\tthe applicant may be granted anticipatory bail.\n<\/p>\n<p>Heard<br \/>\n\tlearned APP for the respondent-State.\n<\/p>\n<p>Heard<br \/>\n\tlearned Counsels for the parties. Be<br \/>\n\tthat as it may, by imposing suitable conditions, I am inclined to<br \/>\n\tgrant anticipatory bail to the applicant.  This Court has<br \/>\n\talso taken into consideration the law laid down by the Apex Court in<br \/>\n\tthe case of <a href=\"\/doc\/1108032\/\">Siddharam Stalingappa Mhetre v. State of<br \/>\n\tMaharashtra &amp; Ors.<\/a> reported in [2011]1 SCC 694,<br \/>\n\twherein the Apex Court reiterated the law laid down by the<br \/>\n\tConstitutional Bench in the case of Shri Gurubaksh Singh<br \/>\n\tSibbia &amp; Ors. reported in [1980]2 SCC 565.\n<\/p>\n<p>Learned<br \/>\n\tCounsels for the parties do not press for further reasoned order.\n<\/p>\n<p>In<br \/>\n\tthe result, this application is allowed by directing that in the<br \/>\n\tevent of the applicant herein being arrested pursuant to FIR being<br \/>\n\tI-C.R. No.19\/2011 with Jalalpore Police Station, Navsari, the<br \/>\n\tapplicant shall be released on bail on furnishing a bond of<br \/>\n\tRs.10,000\/- (Rupees Ten Thousand Only) with one surety of like<br \/>\n\tamount on following conditions :-\n<\/p>\n<p>(a) shall<br \/>\ncooperate with the investigation and make himself available for<br \/>\ninterrogation whenever required;\n<\/p>\n<p>(b) shall<br \/>\nremain present at the concerned Police Station on 6th<br \/>\nAPRIL, 2011 between 11.00 AM TO 2.00 PM;\n<\/p>\n<p>(c) shall<br \/>\nnot hamper the investigation in any manner nor shall directly or<br \/>\nindirectly make any inducement, threat or promise to any witness so<br \/>\nas to dissuade them from disclosing such facts to the Court or to any<br \/>\nPolice Officer;\n<\/p>\n<p>(d) shall<br \/>\nat the time of execution of bond, furnish the address to the<br \/>\nInvestigating Officer and the Court concerned and shall not change<br \/>\nthe residence till the final disposal of the case or till further<br \/>\norders;\n<\/p>\n<p>(e) will<br \/>\nnot leave India without the permission of the Court and, if is<br \/>\nholding a Passport, shall surrender the same before the trial Court<br \/>\nimmediately;\n<\/p>\n<p>(f) It<br \/>\nwould be open to the Investigating Officer to file an application for<br \/>\nremand, if he considers it just and proper and the concerned<br \/>\nMagistrate would decide it on merits.\n<\/p>\n<p>(g)<br \/>\ndespite this order, it would be open for the Investigating Agency to<br \/>\napply to the competent Magistrate, for police remand of the<br \/>\napplicant.  The applicant shall remain present before the learned<br \/>\nMagistrate on the first date of hearing of such an application and on<br \/>\nall subsequent occasions, as may be directed by the learned<br \/>\nMagistrate.  This would be sufficient to treat the accused in the<br \/>\njudicial custody for the purpose of entertaining application of the<br \/>\nprosecution for police remand.  This is, however, without prejudice<br \/>\nto the right of the accused to seek stay against an order of remand,<br \/>\nif ultimately granted, and the power of the learned Magistrate to<br \/>\nconsider such a request in accordance with law.  It is clarified that<br \/>\nthe applicant, even if, remanded to the police custody, upon<br \/>\ncompletion of such period of police remand, shall be set free<br \/>\nimmediately, subject to other conditions of this anticipatory bail<br \/>\norder.\n<\/p>\n<p>Rule<br \/>\n\tmade absolute.
