JUSTICE ABHILASHA KUMARI\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 03\/05\/2011 \n\n \n\n \n \nORAL\nORDER<\/pre>\n<p>1.\tThis<br \/>\napplication has been filed with a prayer to bring on record the<br \/>\napplicants, being heirs and legal representatives of the deceased<br \/>\npetitioner Shri R.P. Patel of Special Civil Application No.7502 of<br \/>\n2004, on the record of the petition.\n<\/p>\n<p>2.\tI<br \/>\nhave heard Ms. Shanu Pathan, learned advocate for Mr. A.M. Raval,<br \/>\nlearned counsel for the applicants and perused the averments made in<br \/>\nthe application. It is averred that the original petitioner Shri R.P.<br \/>\nPatel expired on 11.01.2011, as evidenced from a copy of the Death<br \/>\nCertificate annexed at Annexure-&#8216;I&#8217; to the application. The<br \/>\napplicants are the son and wife of the deceased petitioner,<br \/>\nrespectively, and as the cause to sue survives to the applicants, the<br \/>\nprayers made in the application may be granted.\n<\/p>\n<p>3.\tHaving<br \/>\nheard the learned advocate for the applicants and in view of the fact<br \/>\nthat the original petitioner Shri R.P. Patel expired on 11.01.2011<br \/>\nand the applicants are son and wife of the deceased petitioner<br \/>\nrespectively, it would be just and proper to permit them to be<br \/>\nbrought on the record of the said petition.\n<\/p>\n<p>4.\tAccordingly,<br \/>\nthe application is allowed. The applicants are permitted to be<br \/>\nbrought on the record of Special Civil Application No.7502 of 2004 in<br \/>\nplace of the deceased petitioner Shri R.P.
