K. Upadhayay, learned counsel<\/p>\n<p>                           for Rajendra Agricultural University, Bihar.<\/p>\n<p>                                       The prayer of the petitioner in this writ petition<\/p>\n<p>                           reads as follows:-\n<\/p>\n<blockquote><p>                                                  &#8220;(I) Issuance of a writ of<br \/>\n                                       Certiorari quashing the reasoned order<br \/>\n                                       bearing No. 09\/Legal\/04\/Cs\/RAU, dated<br \/>\n                                       16.2.2006 duly communicated through the<br \/>\n                                       Associate Dean Cum Principal, Bihar<br \/>\n                                       Agriculture College Sabour, Bhagalpur vide<br \/>\n                                       his Memo No. 3650 dated 28.02.2006<br \/>\n<span class=\"hidden_text\">       2<\/span><\/p>\n<p>(Annexure-21) thereby and thereunder the<br \/>\nclaims of the petitioner to grant the pay scale<br \/>\nof the post of Security Supervisor i.e. Rs.325-\n<\/p><\/blockquote>\n<p>525\/- with effect from 18.7.1980 with its<br \/>\nrevisions from 1.4.1981, 1.1.1986 and<br \/>\n1.1.1996 in terms of 4th, 5th and 6th Pay<br \/>\nRevisions duly accepted and implemented in<br \/>\nthe University, has been illegally rejected<br \/>\nwithout considering the strong grounds and in<br \/>\nviolation of the order of this Hon\u201fble Court as<br \/>\nalso the recommendation of the Selection<br \/>\nCommittee.<\/p>\n<p>            (II) Issuance of a writ of<br \/>\nmandamus        directing    the    Respondent<br \/>\nUniversity to grant the prescribed pay scale of<br \/>\nthe post of security supervisor i.e. Rs.325-<br \/>\n525\/- with effect from 11.07.1979 in<br \/>\naccordance with office order no. II-Estt-Aptt-<br \/>\n075\/78-539 dated 18.7.1980 (Annexure-6),<br \/>\nwith its revision to Rs.680-965\/- w.e..f.<br \/>\n1.1.1981 vide University letter no. 334 dated<br \/>\n24.02.1982 (Annexure-3), Rs. 1320-2040\/-<br \/>\nw.e.f. 01.01.1986 in terms of letter No.<br \/>\nIII\/Bud \/Misc. 503\/RAU dated 20.2.1990<br \/>\n(Annexure-4) and Rs.4000-6000\/- w.e.f.<br \/>\n1.1.1996 in terms of office order No. 571<br \/>\ndated 16.10.2003 (Annexure-5) with First<br \/>\nTime Bound Promotion on completion of 10<br \/>\nyears of service with effect from 11.07.1989<br \/>\nin the pay scale of Rs.1400-2300\/-. The<br \/>\npetitioner may also be granted further<br \/>\npromotions under the Assured Career<br \/>\nProgression scheme with effect from 9.8.1999<br \/>\nin the pay scale of Rs.4500-7000\/- and on<br \/>\ncompletion of 24 years of service in the pay<br \/>\nscale of Rs.5000-8000\/- with effect from<br \/>\n11.7.2003.\n<\/p>\n<p>            (III) Issuance of declaration that<br \/>\ndenial of the prescribed pay scale of the post<br \/>\nof Security Supervisor from the due date is<br \/>\nillegal, unjustified and without jurisdiction<br \/>\nand the Reasoned order passed by the<br \/>\nrespondent at Annexure 21 denying the pay<br \/>\n<span class=\"hidden_text\">                    3<\/span><\/p>\n<p>            scale to the petitioner is liable to be set aside<br \/>\n            being violation of Article 14 (doctrine of<br \/>\n            equal pay for equal work) of the Constitution<br \/>\n            of India as well as the order of this Hon\u201fble<br \/>\n            Court without any valid ground be declared as<br \/>\n            void abinito.&#8221;\n<\/p>\n<p>            Though Mr. Ojha, learned counsel appearing on<\/p>\n<p>behalf of the petitioner has addressed this Court on several<\/p>\n<p>aspects, one which would really clinch the issue is the nature<\/p>\n<p>of impugned order. He would submit that the petitioner had<\/p>\n<p>invoked the principle of \u201eequal pay for equal work\u201f on the<\/p>\n<p>ground that he too was duly qualified for the post of Security<\/p>\n<p>Supervisor and being an ex-serviceman equivalent to<\/p>\n<p>Hawardar and he was entitled for the pay-scale which was<\/p>\n<p>given to the Security Supervisor at the University<\/p>\n<p>headquarters. Counsel for the petitioner would further<\/p>\n<p>submit that when this Court therefore had directed the<\/p>\n<p>authorities to consider the grievance of the petitioner by an<\/p>\n<p>order dated 30.8.2005 in CWJC No. 7805 of 2004, it was<\/p>\n<p>expected that University will consider the grievance of the<\/p>\n<p>petitioner with an open mind and at least briefly record the<\/p>\n<p>reasons even if the claim of the petitioner was not allowed.<\/p>\n<p>In this context, he has referred to the detailed representation<\/p>\n<p>filed by the petitioner running into 11 full escape pages<br \/>\n<span class=\"hidden_text\">                   4<\/span><\/p>\n<p>wherein the petitioner had raised various facets for claiming<\/p>\n<p>parity of the post of Security Supervisor at the University<\/p>\n<p>Headquarter with the consequential pay-scale and has<\/p>\n<p>submitted that there is no consideration to the aspects raised<\/p>\n<p>by the petitioner in the impugned order.<\/p>\n<p>           Counsel for the University had tried to defend<\/p>\n<p>the impugned order by taking a plea that the University had<\/p>\n<p>always maintained quantitative and qualitative difference in<\/p>\n<p>the post and pay-scale of the employees at the University<\/p>\n<p>Headquarter and its constituent units and since the<\/p>\n<p>appointment of the petitioner was made for the constituent<\/p>\n<p>unit in a prescribed pay-scale of Rs.180-242 by keeping a<\/p>\n<p>post of Class IV employee in abeyance, it was difficult for<\/p>\n<p>the University to make a departure only in the case of the<\/p>\n<p>petitioner for giving him the pay-scale of Security<\/p>\n<p>Supervisor of the University Headquarters.<\/p>\n<p>           Counsel for the University has also tried to take<\/p>\n<p>a plea that the qualification for the post of Security<\/p>\n<p>Supervisor at the University Headquarter had not only<\/p>\n<p>required an ex-army man to have held the post of Hawardar<\/p>\n<p>or Subedar but also in the pay-scale of Rs.1200 to 1800\/-,<br \/>\n<span class=\"hidden_text\">                    5<\/span><\/p>\n<p>which the petitioner was not possessing at the time of his<\/p>\n<p>appointment in the constituent unit of the University.<\/p>\n<p>            In the considered opinion of this Court, the<\/p>\n<p>cryptic order passed by the Director Administration under<\/p>\n<p>the decision of the Vice-Chancellor of the University does<\/p>\n<p>not deal with the facts and specially that part of claim of the<\/p>\n<p>petitioner that he was qualified and entitled for post in the<\/p>\n<p>pay-scale of Security Supervisor in the University<\/p>\n<p>headquarters inasmuch as a rank of signal man in the army<\/p>\n<p>was equivalent to Hawaldar\/Subedar.\n<\/p>\n<p>            Apart from the fact that the concept of equal pay<\/p>\n<p>for equal work has to be enforced in rare of the rarest cases,<\/p>\n<p>the said concept has also inherent in limitation in the eye of<\/p>\n<p>law and therefore once the petitioner had undertaken to<\/p>\n<p>establish that he was entitled to pay-scale of Security<\/p>\n<p>Supervisor at the Headquarters Level, the authorities were at<\/p>\n<p>least required to consider the grievance raised by the<\/p>\n<p>petitioner in his representation in the light of settled<\/p>\n<p>principle of the requirement of fulfilling the test of equal pay<\/p>\n<p>for equal work. Apparently, that has not been done by the<\/p>\n<p>authorities of University while passing impugned order and<br \/>\n<span class=\"hidden_text\">                   6<\/span><\/p>\n<p>therefore this Court has no hesitation in quashing the<\/p>\n<p>impugned order as contained in Annexure-1.<\/p>\n<p>            The impugned order as contained in Annexure-1<\/p>\n<p>is accordingly quashed and the matter is remitted to the<\/p>\n<p>Vice-Chancellor of Rajendra Agriculture University who<\/p>\n<p>would now reconsider the case of the petitioner in the light<\/p>\n<p>of the facts stated and the grounds taken in the detailed<\/p>\n<p>representation filed by the petitioner on 29.9.2005 vide<\/p>\n<p>Annexure-20 to the writ petition. The Vice-Chancellor of the<\/p>\n<p>University must pass his own speaking and reasoned order<\/p>\n<p>within a period of three months from the date of<\/p>\n<p>receipt\/production of a copy of this order and if he finds the<\/p>\n<p>petitioner entitled for payment of higher emolument either at<\/p>\n<p>par with the Security Supervisor at University Headquarters<\/p>\n<p>or to any other pay-scale, the financial benefit thereof also<\/p>\n<p>must be given to the petitioner by way of actual cash<\/p>\n<p>component from 30.8.2005 i.e. when this Court had earlier<\/p>\n<p>remitted the mater while disposing of the first writ petition<\/p>\n<p>on the subject filed by the petitioner being CWJC No. 7804<\/p>\n<p>of 2004. The petitioner will also be entitled for payment of<\/p>\n<p>his retirement benefit in the revised pay-scale of Security<br \/>\n<span class=\"hidden_text\">                                7<\/span><\/p>\n<p>           Supervisor, if his claim is allowed by the Vice Chancellor of<\/p>\n<p>           the University.\n<\/p>\n<p>                       It is, however, made clear that this Court has not<\/p>\n<p>           put its final word on such claim of the petitioner by way of<\/p>\n<p>           equal pay for equal work and has only directed the Vice-<\/p>\n<p>           Chancellor of the University to take his independent<\/p>\n<p>           decision strictly in accordance with law.<\/p>\n<p>                       Such exercise, however, must be completed by<\/p>\n<p>           the Vice-Chancellor of the University within a period of<\/p>\n<p>           three months from the date of receipt\/production of a copy<\/p>\n<p>           of this order.\n<\/p>\n<p>                       With the aforementioned observations and<\/p>\n<p>           direction, this writ petition is disposed of.<\/p>\n<pre>kanchan.
