We \u00a0 heard \u00a0 this \u00a0 case \u00a0 through \u00a0 videoconferencing. \u00a0 The \u00a0 Appellant \u00a0 was\u00a0<\/p>\n<p>present\u00a0in\u00a0the\u00a0Nainital\u00a0studio\u00a0of\u00a0the\u00a0NIC.\u00a0The\u00a0Respondents\u00a0were\u00a0present\u00a0in\u00a0our\u00a0<\/p>\n<p>chamber.\u00a0We\u00a0heard\u00a0their\u00a0submissions.\n<\/p>\n<\/p>\n<p>3.      The\u00a0Appellant\u00a0had\u00a0sought\u00a0some\u00a0information\u00a0regarding\u00a0the\u00a0anti\u00ad\u00a0Sikh\u00a0riots\u00a0<\/p>\n<p>which\u00a0had\u00a0taken\u00a0place\u00a0in\u00a01984\u00a0and\u00a0the\u00a0role\u00a0of\u00a0Sri\u00a0Rajiv\u00a0Gandhi,\u00a0the\u00a0then\u00a0Prime\u00a0<\/p>\n<p>CIC\/WB\/A\/2010\/000426\u00adSM<br \/>\n Minister\u00a0in\u00a0those\u00a0riots.\u00a0The\u00a0CPIO\u00a0had\u00a0informed\u00a0him\u00a0that\u00a0in\u00a0the\u00a0absence\u00a0of\u00a0any\u00a0<\/p>\n<p>specific\u00a0reference\u00a0to\u00a0any\u00a0case,\u00a0they\u00a0did\u00a0not\u00a0have\u00a0any\u00a0such\u00a0information\u00a0to\u00a0share\u00a0<\/p>\n<p>on\u00a0this\u00a0subject.\u00a0During\u00a0the\u00a0hearing\u00a0also,\u00a0the\u00a0Respondents\u00a0reiterated\u00a0the\u00a0same\u00a0<\/p>\n<p>arguments.\u00a0They\u00a0explained\u00a0that\u00a0there\u00a0was\u00a0no\u00a0such\u00a0report\u00a0available\u00a0in\u00a0the\u00a0CBI\u00a0<\/p>\n<p>regarding \u00a0 the \u00a0 anti\u00ad \u00a0 Sikh \u00a0 riots \u00a0 which \u00a0 had \u00a0 taken \u00a0 place \u00a0 in \u00a0 1984. \u00a0 They\u00a0 further\u00a0<\/p>\n<p>explained\u00a0that\u00a0the\u00a0CBI\u00a0had\u00a0not\u00a0investigated\u00a0the\u00a0role\u00a0of\u00a0the\u00a0then\u00a0Prime\u00a0Minister\u00a0<\/p>\n<p>in\u00a0these\u00a0riots.\u00a0Thus,\u00a0they\u00a0submitted\u00a0that\u00a0they\u00a0had\u00a0no\u00a0specific\u00a0information\u00a0to\u00a0<\/p>\n<p>disclose.\n<\/p>\n<\/p>\n<p>4.      After\u00a0carefully\u00a0considering\u00a0 the\u00a0facts\u00a0of\u00a0the\u00a0case\u00a0and\u00a0the\u00a0submissions\u00a0<\/p>\n<p>made\u00a0by\u00a0both\u00a0the\u00a0parties,\u00a0we\u00a0tend\u00a0to\u00a0agree\u00a0with\u00a0the\u00a0above\u00a0contentions\u00a0of\u00a0the\u00a0<\/p>\n<p>Respondents.\u00a0If\u00a0the\u00a0CBI\u00a0does\u00a0not\u00a0hold\u00a0any\u00a0such\u00a0information,\u00a0we\u00a0cannot\u00a0compel\u00a0<\/p>\n<p>the\u00a0CPIO\u00a0to\u00a0disclose\u00a0it.\u00a0We\u00a0would\u00a0like\u00a0to\u00a0advise\u00a0the\u00a0Appellant\u00a0that,\u00a0if\u00a0he\u00a0so\u00a0likes,\u00a0<\/p>\n<p>he\u00a0can\u00a0seek\u00a0any\u00a0specific\u00a0information\u00a0that\u00a0the\u00a0CBI\u00a0may\u00a0have\u00a0in\u00a0its\u00a0possession\u00a0<\/p>\n<p>and\u00a0the\u00a0CPIO\u00a0can\u00a0then\u00a0consider\u00a0disclosing\u00a0such\u00a0information,\u00a0if\u00a0available,\u00a0and\u00a0if\u00a0<\/p>\n<p>not\u00a0exempted\u00a0under\u00a0any\u00a0of\u00a0the\u00a0provisions\u00a0of\u00a0the\u00a0Right\u00a0to\u00a0Information\u00a0(RTI)\u00a0Act.<\/p>\n<p>5.      The\u00a0appeal\u00a0is\u00a0disposed\u00a0off\u00a0accordingly.\n<\/p>\n<p>6.
